AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING A MORATORIUM ON THE PROCESSING AND ISSUANCE OF BUILDING PERMITS AND ZONE EXCEPTION PERMITS FOR TEMPORARY USES IN THE NEWPORT BOULEVARD MEDIAN, DECLARING SAID ORDINANCE TO BE AN URGENCY ORDINANCE AND SETTING FORTH THE REASONS THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa finds and declares that there is a current and immediate threat to the public health, safety, and general welfare and that the approval of additional building permits, Zone Exception Permits, or any other applicable entitlements for uses of the Newport Boulevard median would endanger the public health, safety, and welfare. ACCORDINGLY, the following urgency measure is adopted. SECTION 2. The City Staff is hereby directed not to process any applications for permits nor issue any permits of any kind for temporary uses of the Newport Boulevard median for the duration of this Ordinance; provided, however, that any application for City action that was on file with the City, or any permit issued by the City, before February 21, 1984 shall not be denied, enjoined, or otherwise prevented from being pursued or completed solely by reason of the adoption of this Ordinance. Such projects may be processed or completed if otherwise approved by the City. SECTION 3. The City Council finds and declares that the protection of the public health, safety, and general welfare requires that this Ordinance be adopted as an urgency measure, pursuant to Section 65858, California Government Code.. The reasons in support of the necessity of an urgency measure are as follows: Conditional use permits for certain temporary uses, primarily outdoor storage in connection with neighboring commercial uses, have been approved for the Newport Boulevard median, and applications for further similar uses continue to be received; These uses have created problems and concerns, including excessive noise and unsightliness, adversely affecting businesses and residents in the vicinity; Problems and concerns also arise from the fact that Newport Boulevard is the principal arterial route into and through the City of Costa Mesa, so that visual ugliness at that sensitive location conveys a poor impression of the City and constitutes a blighting influence and a detriment to development throughout the City of Costa Mesa; Time is required to draft and adopt a new ordinance to control, regulate and, if neceessary, abate uses located in the Newport Boulevard median in order to protect the public health, safety and welfare. SECTION 4. This Ordinance shall take effect and be in full force immediately from and after its passage, and prior to the expiration of fifteen (15) days from the passage thereof, shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa together with the names of the members of the City Council voting for and against the same. The provi- sions of this Ordinance shall be effective for a period of forty-five (45) days after adoption.
