HomeMy WebLinkAbout84-12 Amending Code; Parking and Storage of Motor Vehicles in Yard Areas in Residential ZonesORDINANCE NO. 84-12 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING THE COSTA MESA MUNICIPAL CODE RELATING TO PARKING AND STORAGE OF MOTOR VEHICLES IN ARD AREAS IN RESIDENTIAL ZONES. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS SECTION 1. The City Council of the City of Costa Mesa finds and declares that: (a) The parking or storage of motor vehicles, camp trailers, campers, trailers, and boats in yard areas in residential zones is detrimental to the aesthetics of neighborhoods and causes a loss of market values of other properties in the surrounding area; and (b) Existing ordinances concerning development standards for resi- dential properties are not sufficient to prevent the use of such yard areas for parking and storage of motor vehicles, camp trailers, campers, trailers, and boats, and such use has become a problem to homeowners in some portions of the City of Costa Mesa. ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends the Costa Mesa Municipal Code as follows: SECTICN 2. Section 13-548 is added to Chapter V of Title 13, to read as follows: "Section 13-548. Use of yard areas for parking or storage of motor vehicles, camp trailers, campers, trailers, and boats. (a) No person who owns or is in possession of any parcel in a resi- dential zone shall permit the parking or storage of any motor vehicle (as defined in California Vehicle Code Section 415), whether operable or not, or of any camp trailer, camper, or trailer (as defined in California Vehicle Code Sections 242, 243, and 630, respectively), or of any camper shell or boat, in any yard area visible from a public street, except upon a paved driveway connecting a garage or carport with a public street, unless the parked or stored items are screened from each public street abutting the parcel by opaque fencing, six feet in height, in accordance with applicable development standards." SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE CQAST DAILY'PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
