ORDINMCE NO. 84-14
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFOW IA, REGARDING SIGN
MAINTENANCE.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORrA1N AS
SECTION 1.
1. The City Council finds and declares that:
a. Abandoned or .poorly maintained signs are a blighting influ-
ence on the City;
b. Poorly maintained signs can pose a significant safety
hazard;
C. It is in the interest of the public health, safety, and
general welfare to require that signs be properly main-
tained or removed.
ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends
the Costa Mesa Municipal Code as set forth below:
SECTION 2.
Add Sections 5-121(1), (m), and (n) as follows:
(1) Maintenance and Repair. Every sign shall be maintained in a
safe, structurally sound condition and in good repair at all times.
(m) Abatement of Unsafe Signs. When it is determined by the Director
of Development Services that a sign, such as an abandoned or materially
dangerous, or electrically or structurally defective sign, constitutes a
clear and present danger to the public health or safety, the Director of
Development Services shall seek to have the dangerous situation corrected
immediately. If the sign owner or person in control of the site cannot be
contacted promptly or, if contacted, refuses or fails to take immediate
steps to correct the dangerous condition, the Director of Development
a
Services shall cause the sign to be removed or repaired to make it safe.
Notification of removal or repair shall be personally delivered or mailed
to the sign owner, if known, and to the person in control of the site, by
Certified Mail within forty-eight (48) hours after removal or repair. The
sign owner or other person may request a hearing before the City Manager,
or his or her designee, within fourteen (14) days of mailing or delivery
of notification, by telephone or written request to the Director of Devel-
opment Services. Unless the hearing officer finds that the sign did not
constitute a clear and present danger to the public health or safety, the
expense of repair or removal, and any storage expense, shall become a
joint and several obligation of the sign owner and the person in control
of the site. Any sign unclaimed within sixty (60) days after mailing or
delivery of the notice of removal shall become the property of the City and
may be disposed of in any manner deemed appropriate by the City.
(n) Labels. Each sign hereafter erected or remodeled shall bear, in
a permanent position, clearly legible decals identifying the firm or
corporation responsible for its construction and erection. Electric signs
shall be marked with input amperages at the full load input.
Amend Section 5-120(A) to read:
"(A) Permit required. A sign permit shall be obtained from the
Development Services Department prior to the placing, erecting, moving,
reconstructing, altering, or displaying of any sign, including painted wall
signs, unless exempted by Section 5-121(c) of this Article. For the pur-
pose of notifying property owners of the existence of conforming signs and
to regulate the number of information items, a sign permit shall also be
obtained prior to the change of copy of existing signs.
All signs shall comply with the appropriate, detailed provisions of

Title 5 of the Costa Mesa Municipal Code relative to construction, struc-
tural integrity, connections, and safety. Signs shall also comply with the
provisions of the applicable Electrical Code and the additional construc-
tion standards set forth in this Section. A building permit and/or elec-
trical permit may be required."
SECTIM 3. This Ordinance shall take effect and be in full force
thirty (30) days from and after the passage thereof, and prior to the
expiration of fifteen (15) days from its passage shall be published once in
the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed
and published in the City of Costa Mesa or, in the alternative, the City
Clerk may cause to be published a summary of this Ordinance and a certified
copy of the text of this Ordinance shall be posted in the office of the
City Clerk five (5) days prior to the date of adoption of this Ordinance,
and within fifteen (15) days after adoption, the City Clerk shall cause to
be published the aforementioned summary and shall post in the office of
the City Clerk a certified copy of this Ordinance together with the names
of the members of the City Council voting for and against the same.
