AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, CONCERNING UNDERGROUND
STORAGE TANKS CONTAINING HAZARDOUS MATFRIA S.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa finds and
declares as follows:
1. The State of California recently enacted legislation for the
inspection and regulation of the storage of hazardous substances in under-
ground tanks and piping, now contained in Health and Safety Code Sections
25150.1 and 25280 through 25289.
2. These laws permit a city, by ordinance, to assume exclusive
responsibility for implementation.
3. Substances hazardous to public health and safety and to the
environment are stored, prior to use or disposal, in underground locations
throughout the City of Costa Mesa.
4.. Underground tanks used for the storage of hazardous substances and
wastes are potential sources of contamination of the ground and underlying
aquifers and may pose other dangers to public health and the environment.
5. Several cases have been reported and confirmed of underground
storage having resulted in undetected and uncontrolled releases of hazard-
ous substances into the ground. These releases have contaminated public
drinking water supplies and created a potential threat to public health and
to the waters of the State.

6. The City Council declares that it is in the public interest to
establish a continuing program for the purpose of preventing contamination
frau, and improper storage of, hazardous substances stored underground.
7. The City Council of the City of Costa Mesa desires that implemen-
tation should begin immediately within the corporate limits of the City of
Costa Mesa and that the program be administered by the Costa Mesa Fire
Department.
ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends
Title 7 of the Costa Mesa Municipal Code as hereinafter set forth:
SECTION 2.
1. Add Section 7-61 to read:
"Sec. 7-61. Amendments to Article 80 of Code, 'Hazardous Materials'.
"Sec. 80-113, Storage of Hazardous Substances in Underground Tanks.
The requirements of Assembly Bill No. 1362, enacted as Chapter 1046 of
the 1983 Statutes, and codified as California Health and Safety Code
Section 25150.1 and Sections 25280 through 25289 inclusive, and subse-
quent amendments thereto, are hereby adopted by reference as the
standards of the City of Costa Mesa for the underground storage of
hazardous substances."
"Sec. 80-114, Local Agency. For the purposes of administering and
enforcing the provisions of Health and Safety Code Section 25150.1 and
Sections 25280 through 25289, the City of Costa Mesa Fire Department,
Fire Prevention Bureau, is designated as the local agency."
"Sec. 80-115, Permit Fee. A schedule of fees for applications,
inspections, and permits to store hazardous materials in an under-
ground tank shall be established by Resolution of the City Council.

Such fees, plus any surcharge legislated by the State of California
and permit and plan check fees required by the Uniform Building Code,
shall be collected at the time of the application for permit."
SECTION 3. This Ordinance shall take effect and be in full force
thirty (30) days from and after the passage thereof, and prior to the
expiration of fifteen (15) days from its passage shall be published once in
the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed
and published in the City of Costa Mesa or, in the alternative, the City
Clerk may cause to be publisheda summary of this Ordinance and a certified
copy of the text of this Ordinance shall be posted in the office of the
City Clerk five (5) days prior to the date of adoption of this Ordinance,
and within fifteen (15) days after adoption, the City Clerk shall cause to
be published the aforementioned summary and shall post in the office of
the City Clerk a certified copy of this Ordinance together with the names
of the members of the City Council voting for and against the same.
