HomeMy WebLinkAbout84-32 Barber and Beauty Shops, Restaurants and Theaters, and Handicapped Parking StallsORDINANCE NO. 84-32 AN ORDINANCE OF THE CITY -COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CONCERNING BARBER AND BEAUTY SHOPS IN THE COMMERCIAL LIMITED (CL) ZONE, LOCATION OF RESTAURANTS AND THEATRES WITHIN 200 FEET OF RESIDENTIAL ZONES, NUMBER OF PARKING STALLS REQUIRED FOR THE HANDICAPPED, AND STANDARDS FOR THE Ml ZONE. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS • �el-mr SECTION 1. 1. Previous ordinance amendments have made some sections of Title 13 redundant or obsolete; 2. Removing redundant and obsolete sections will clarify the ordi- nance and facilitate its administration; 3. Beauty and barber shops do not adversely impact surrounding uses more than retail shops; 4. Restaurants and bars can adversely impact nearby residential uses by odors, noise, and trash; 5. City requirements, concerning the number of parking stalls for the handicapped, do not conform to current State requirements. ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends Title 13 of the Costa Mesa Municipal Code as hereinafter set forth: SECTION 2. 1. Amend Section 13-227 by adding a subsection as follows: "4. Barber and Beauty Shops." 2. Amend Section 13-197(4) to read as follows: "4. Theaters (not within two hundred (200] feet of a residential zone)." 3. Amend Section 13-197(5) to read as follows: "5. Establishments where food or beverages are served (not within two hundred [200] feet of a residential zone)." 4. Amend Section 13-198 to read as follows: "Conditional Uses: 1. Service stations 2. Automotive repair and service 3. Establishments where food or beverages are served (within two hundred [200] feet of a residential zone) 4. Theaters (within two hundred [200] feet of a residential zone) 5. Health clubs and spas 6. Adult entertainment businesses 7. Additional commercial uses not provided for as a permitted use may be considered for approval as a conditional use according to the procedures set forth in this Code 8. Buildings in excess of two (2) stories or thirty (30) feet." 5. Amend Section 13-208(10) to read as follows: "10. Establishments where food or beverages are served (not within two hundred [200] feet of a residential zone)." 6. Amend Section 13-208(11) to read as follows: "11: Theaters (not within two hundred [200] feet of a residential zone)." 7. Amend Section 13-209 to read as follows: "Conditional Uses: 1. Motels and hotels 2. Auditoriums 3. Dry cleaning plants 4. Health and sports clubs and spas 5. Automotive, motorcycle, and boat dealerships (including sales and service) 6. Service clubs engaged in public service and not operated pri- marily for profit 7. Service stations 8. Retail nurseries (no bulk fertilizer storage) 9. Preschools, day-care centers, nursing hones and convalescent hospitals 10. Establishments where food or beverages are served (within two hundred [200] feet of a residential zone) 11. 'Theaters (within two hundred [200] feet of a residential zone) 12. Adult entertainment businesses 13. Other cammercial uses not provided for as a permitted use may be considered for approval as a conditional use, according to the provisions set forth in this title 14. Buildings in excess of two (2) stories or thirty (30) feet." 8. Amend Section 13-223 to read as follows: "Conditional Uses: 1. All conditional uses in the Local Business (Cl) District 2. Lumber yards 3. Automotive body and paint shops 4. Public gymnasiums, skating rinks, sports clubs, and amusement centers 5. Automotive repair." 9. Amend Sections 13-558 and 13-568 to read as follows: "(a) Parking for the handicapped shall be provided as required by Title 24 of the California Administrative Code. UP. " (b) Fractions equal to or above one-half (0.5) shall be rounded 10. Add Section 13-416(4) as follows: "(d) Properties zoned Ml shall be considered to be zoned MG for the purposes of determining what uses are permitted, what signage is allowed, and what development standards pertain." SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the ex- piration of fifteen (15) days frcan its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the day of adoption of this Ordinance and within fifteen (15) days after adoption, the City Clerk shall cause to be published, the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
