AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA ENACTING A ZONING
MORATORIUM ON FORTUNETELLING BUSINESSES.
THE CITY COUNCIL OF THE CITY OF COSTA MESA FINDS AND DECLARES:
SECTION 1. The City Council finds that there is a current and immediate
threat to the public health, safety, or welfare, and that the approval of addi-
tional subdivisions, zonings, land use permits, variances, building permits, or
any other applicable entitlement for use which is required in order to comply
with the Zoning Ordinance of the City of Costa Mesa would result in a threat to
the public health, safety, or welfare, in that the City is currently considering
repealing an existing ban on fortunetelling and there is no existing zoning regu-
lation for the location and standards applicable to fortunetelling businesses;
the unregulated establishment of fortunetelling businesses within the City would
result in a threat to public health, safety, or welfare; and a resonable time is
needed for the City to study appropriate zoning classifications and regulations
for fortunetelling businesses.
THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 2. Fortunetelling as defined herein is hereby prohibited within
the City of Costa Mesa during the tern of this interim ordinance and any exten-
sions thereof.
Fortunetelling, as used in this ordinance, shall include astrology, palmis-
try, phrenology, lifereading fortunetelling, cartomancy, clairvoyance, clair-
audience, crystal gazing, mediumship, spirit photography, spirit writing, spirit
voices, spirit materialization, etherealization, prophecy, augury, divination,
necromancy, fortunetelling by handwriting analysis, or other similar business or
act.
This interim ordinance is adopted as an urgency measure to prohibit any uses
which may be in conflict with a contemplated zoning proposal concerning fortune-
telling which the legislative body is considering or studying or intends to study
within the terms of this ordinance. This ordinance shall be of no further force
and effect forty-five (45) days frau the date of its adoption, unless extended
pursuant to Government Code §65858.
SECTION 3. This ordinance shall take effect and be in full force immediately
from and after the passage thereof, and prior to the expiration of fifteen (15)
days from its passage, shall be published once in the Orange Coast Daily Pilot,
a newspaper of general circulation, printed and published in the City of Costa
Mesa, together with the names of the members of the City Council voting for and
against the same.
