HomeMy WebLinkAbout85-19 Concerning Small Car Parking and Commercial Parking RequirementsORDINANCE NO. 85-19 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, INCREASING THE AMOUNT OF SMALL CAR PARKING ALLOWED FOR NON -RETAIL DEVELOPMENTS, RENUMBERING SECTIONS DEALING WITH COMMERCIAL PARKING REQUIREMENTS AND CLARIFYING WORDING OF SECTIONS DEALING WITH APPLICABLITY OF PARKING REQUIREMENTS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council finds and declares as follows: 1. The percentage of small cars in the vehicle population has increased over the years and small cars now out -number large cars in Costa Mesa. 2. Parking facilities serving frequent, long-term parkers can func- tion effectively with a greater percentage of small -car parking spaces than can facilities serving infrequent, short-term parkers. ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends Title 13 of the Costa Mesa Municipal Code as hereinafter set forth: SECTION 2. 1. R -,locate and renumber the following sections as indicated: Old Number Title New Number 13-561 Shopping Center Parking 13-553 Parking Hrquirements for Uses Not Specified 13-560 mall Car Parking 13-558 Handicapped Parking 13-557 Location 13-555 Parking Spaces Permanently Available for Automobile Parking 13-556 Declaration of Land Use Restriction 13-553 13-555 13-556 13-557 13-558 13-560 13-561 2. Amend the first paragraph of Section 13-546 to read: °DEVELOPMENT STANDNRDS. All parking shall be provided in accordance with the following development standards: ..." 3. Amend Section 13-547 to read: " SMALL CAR PARKING. For projects with more than fifteen (15) unassigned parking spaces, forty (40) per cent of all unassigned spaces may be small car spaces. Said small car spaces shall amply with City of Costa Mesa standards and shall be clearly marked "SMALL CAR ONLY" under the direction of the Director of Development Services. Unassigned parking spaces shall include all guest spaces in condcaninium developments and all parking spaces in excess of one covered space per dvtielling unit in apartment developments. Additional parking may be designated as 'unassigned' when and as authorized by the Planning Commission by Conditional Use Pennit. All parking in excess of City requirements may be small car spaces." 4. Amend Section 13-560 (old number)/13-556 (new number) to read: "SMALL CAR PARKING. For projects with more than fifteen (15) spaces, twenty-five (25) percent of required parking may be small car spaces. All spaces in excess of City requirements may be small car spaces. Said small car spaces shall comply with City of Costa Mesa standards and shall be clearly marked 'SMALL CAR ONLY' under the direction of the Director of Development Services. The distribution, location, and marking of small car spaces shall be subject to the approval of the Director of Development Services. - 2 - Where parking is clearly designed to serve long-term, repeat parkers (e.g. employees), the Zoning Administrator may approve small car parking to a maximum of forty (40) percent as a minor Conditional Use Permit as. provided for elsewhere in this title." 5. Amend Section 13-569 to read: "SMALL CAR PARKING. For projects with more than fifteen (15) spaces, forty (40) per- cent of required parking may be small car spaces. All spaces in excess of City requirements may be small car spaces. Said small car spaces shall comply with City of Costa Mesa standards and shall be clearly marked 'SMALL CAR ONLY' under the direction of the Director of Development Services." 6. Amend Section 13-544 to read: "APPLICABILITY The provisions of this article shall apply to residential projects in the R1 -W, R1, R2, R3 and R4 zones and to the residential portions of developments in the Planned Development zones. Parking for non- residential uses in these zones shall be provided as required else- where in this title for such uses." 7. Amend Section 13-551 to read: "APPLICABILITY The provisions of this article shall apply to the AP, CL, Cl, C2, C1S, and TC zones, to commercial portions of developments in the Planned Development zones, to uses listed in Section 13-552 regardless of the zone in which they are located, and to mixed-use developments in all zones." - 3 - 8. Amend Section 13-559(g) to read: "Parking spaces and back-up aisles. Parking spaces and back-up aisles shall conform to 'City of Costa Mesa Parking Standards' which are included herein as Exhibit A and which may be amended from time to time by resolution of the City Council following receipt of the report and recaromendation of the Planning commission and upon a duly noticed public hearing, unless an alternative plan is approved by the Director of Development Services." 9. Amend the first paragraph of Section 13-564 to.read: "APPLICABILITY The provisions of this article shall apply to the MG and MP zones and to industrial portions of developments in the Planned Development zones." SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the sam. - 4 - PASSED AND ADOPTED this 1st day of July, 1985.
