AN -ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, CONCERNING OUTDOOR
SEATING AREAS FOR RESTAURANTS.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORIAIN AS:FOLLCKS:
SECTION 1.
1. Cbnditional Use Permits to allow outdoor seating for restaurants
have been frequently approved in the past;
2. Outdoor seating areas for restaurants are a pleasant ammenity for
the community;
3. Outdoor seating areas will not adversely impact surrounding non-
residential uses;
4. The additional review provided by the Conditional Use Permit
process when -restaurants are within 200' of a residential zone is necessary
to ensure compatibility of outdoor seating areas and adjacent residential
uses;
5. Parking needs for outdoor seating areas are similar to parking
needs for indoor dining areas.
ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends
Title 13 of the Costa Mesa Municipal Code as hereinafter set forth:
SECTION 2.
1. Amend Sections 13-197(5) and 13-208(10) to read:
"Establishments where food or beverages are served (not within two
hundred (200) feet of a residential zone). Such establishments may include
outdoor seating providing that outdoor seating area may not encroach into
.required landscape areas except as approved by the Zoning Administrator."
2. Amend Section 13-198(3) and 13-209(10) to read:
."Establishments where food or beverages are served (within two hun-
dred (200) feet of a residential zone) including outdoor seating for such
establishments."
3. mend Section 13-552(6) to read:
"Restaurants and bars 10 spaces per 1000 sq.ft. of gross

SECTION 3.
This Ordinance shall take effect and be in full force thirty (30) days
frcrn and after the passage thereof, and prior to the expiration of fifteen
.(15) days from its passage shall be published once in the ORANGE COAST
nAILY PILOT, a newspaper of general circulation, printed and published in
the City of Costa Mesa or, in the alternative, the City Clerk may cause to
be published a summary of this ordinance and a certified copy of the text
of this ordinance shall be posted in the office of the City Clerk five (5)
days prior to the date of adoption of this Ordinance, and within fifteen
(15) days after adoption, the City Clerk shall cause to be published the
aforementioned summary and shall post in the office of the City Clerk a
' certified copy of this Ordinance together with the names of the members of
the City Council voting for and against the same.
