AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, RELATING TO THE REGULATION
OF THE PARKING OF VEHICLES.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa hereby finds
and declares as follows:
1. Section 22507 of the California Vehicle Code has been revised to allow
local authorities, by ordinance or resolution, to prohibit or restrict the
parking or standing of vehicles which are six feet or more in height within
100 feet of any intersection, on certain streets or highways, or portions
thereof, during all or certain hours of the day, provided that signs or markings
giving adequate notice of the prohibition or restriction have been placed.
Such regulation is desirable, for safety reasons, to give motorists adequate
protected sight -distance at non -signalized intersections.
2. The Costa Mesa Municipal Code Section 10-185(b) currently excludes
commercial vehicles, truck tractors, house trailers, boat trailers, or
detached trailers parked on nonresidential streets from the 72 consecutive
hour parking prohibition, without sufficient justification for the exclusion.
Accordingly, the Costa Mesa Municipal Code is amended as follows:
SECTION 2. Title 10 is hereby amended to add.subparagraph (d) to Section
10-185 to read as follows:
"Section 10-185(d): No person who owns or has possession, custody or
control of any vehicle which is six feet or more in height (including any.
load thereon) shall park or leave standing any such vehicle on a street or
highway within one hundred (100) feet of any intersection, at any ]vocation
at which such prohibition is indicated by appropriate signs giving notice
thereof. Vehicles found in violation of this section may be cited, or removed
in accordance with the provisions of Section 10-69, or both."
SECTION 3. Title 10 is further amended to revise subparagraph (b) to
Section 10-185 to delete the following language:
Section 10-185(b): ", excluding those defined'in subsection (a) above,".
SECTION 4. This Ordinance shall take effect and be in full force thirty
(30) days from and after the passage thereof, and prior to the expiration
of fifteen (15) days from its passage shall be published once in the ORANGE
COAST DAILY PILOrT, a newspaper of general circulation, printed and published
in the City of Costa Mesa or, in the alternative, the City Clerk may cause
to be published a summary of this Ordinance and a certified copy of the text
of this Ordinance shall be posted in the office of the City Clerk five (5)
days prior to the date of adoption of this Ordinance, and within fifteen
(15) days after adoption, the City Clerk shall cause to be published the
aforementioned summary and shall post in the office of the City Clerk a
certified copy of this Ordinance together with the names of the members of
the City Council voting for and against the same.
