HomeMy WebLinkAbout85-13 Revising the Listing of Positions Covered by the Conflict of Interest CodeORDINANCE NO. 85-13 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, REVISING THE LISTING OF POSITIONS COVERED BY THE CONFLICT OF INTEREST CODE OF THE CITY OF COSTA MESA. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa finds and declares as follows: 1. The City Council of the City of Costa Mesa has previously adopted Ordinance No. 77-46, setting forth a Conflict of Interest Code which has been incorporated into the Costa Mesa Municipal Code as Sections 2-401 through 2-408 thereof, and Exhibit A to that ordinance listing the posi- tions covered by the disclosure provisions of the ordinance. 2. Since the adoption of Ordinance No. 77-46, certain positions listed in Exhibit A have been eliminated, others have been renamed, and new positions have been created that should be included within the scope of the ordinance. 3. An amendment to the Conflict of Interest Code is required to bring the listing of covered positions up to date. Accordingly, the City Council of the City of Costa Mesa amends the Costa Mesa Municipal Code as follows: SECTION 2. The attached Exhibit A is hereby adopted to replace the prior Exhibit A attached to Ordinance No. 77-46, wherein Sections 2-401 through 2-408 of the Costa Mesa Municipal Code were adopted. SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days frau and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same. A desig- nated employee or official for the purpose of this ordinance shall include a spouse and immediate members of the family. Designated Employees in Group "l Real Estate" must report: All investments, and other interests in -ea property and income, therefrom and any business entity in which the person is a director, officer, partner, trustee, employee, or holds any position of management. (Financial interests in this category are reportable only if located within or subject to the jurisdiction of the City of Costa Mesa or the Costa Mesa Sanitary District or if the business entity is doing business or planning to do business in the jurisdiction or has done business within the juris- diction at any time during the two years prior to the filing of the statement.) Designated Employees in Group "2 Investments" must report: Investments in any business entity which, within the last two years, has contracted, or in the future foreseeably may contract with the City of Cosh Mesa or the Costa Mesa Sanitary District to provide services, sup- plies, materials, machinery or equipment to the City or District. Designated Employees in Group "3 Income" must report: Income from any source which, within the last two years has con- tracted, or in the future foreseeably may contract with the City of Costa Mesa or with the Costa Mesa Sanitary District to provide services, sup- plies, materials, machinery or equipment to the City or District. Designated Employees in Group N Status" must report: His or her status as a director, officer, partner, trustee, employee, or holder of a position of management in any business entity, which within the last two years, has contracted, or in the future foreseeably may con- tract with the City of Costa Mesa or with the Costa Mesa Sanitary District to provide services, supplies, materials, machinery or equipment to the City or District.
