HomeMy WebLinkAbout85-12 Relating to Removal of Vehicles Parked on Private Property or City PropertyORDINANCE NO. 85-12 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, RELATING TO REMOVAL OF VEHICLES PARKED ON PRIVATE PROPERTY OR CITY PROPERTY. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Zhe City Council of the City of Costa Mesa finds and declares as follows: Section 22658 of the California Vehicle Code specifically provides for the adoption by a local public entity of an ordinance authorizing the owner or person in possession of private property to cause the removal of parked vehicles from such property; There is a need for such an ordinance, requiring the posting of signs of at least a specified size and containing specified information, as required by California Vehicle Code Section 22658. ACCORDINGLY, the City Council of the City of Costa Mesa amends Title 10, Chapter X of the Costa Mesa Municipal Code as follows: SECTION 2. Section 10-198 is hereby added to the Costa Mesa Municipal Code to read as follows: "Section 10-198. Removal of Parked Vehicles from Private Property. (a) Any owner or person in possession of private property may cause the removal of a parked vehicle from such private property when either of the following conditions is satisfied: (1) The property is improved with a single-family dwelling; or (2) There is displayed,, in plain view at all entrances to the property, a sign at least eighteen inches (18") by twenty- four inches (24") prohibiting public parking and indicating that vehicles will be removed at the owner's expense, and containing the telephone number of the Costa Mesa Police Department. (b) The person causing removal of a vehicle pursuant to paragraph (a) of this section shall comply with all applicable requirements of California Vehicle Code 22658. (c) The provisions of paragraph (a) of this section shall also apply to City -owned property and property rented or leased by the City from another person or entity; the request for removal may be made by any employee of the Police Department, who shall comply with the applicable provisions of Section 10-69 of this Code." SECTION 3. 'This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST LILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
