AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, CONCERNING ACCES-
SORY APARTMENTS IN SINGLE-FAMILY DWELLINGS,.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1.
1. High housing costs are adversely affecting many people, especially
the elderly and others with low or fixed incomes;
2. Accessory apartments can be provided for a lower cost than new
units;
3. Accessory apartments allow more efficient use of the existing
housing stock;
4. Requiring owner -occupancy of one unit on the property will protect
neighborhood quality and stability by encouraging adequate property main-
tenance and tenant supervision;
5. Establishing a maximum size for the accessory apartment will
serve to ensure the subordinate nature of the unit and protect the single-
family character of the neighborhood.
6. A second unit as provided for herein, if located on a conforming
residential lot, does not exceed the allowable density for the lot and is
a residential use, consistent with the General Plan Designation and
applicable zoning.
ACCORDINGLY, the City council of the
City
of
Costa Mesa herewith
amends Title 13 of the Costa Mesa Municipal
Code
as
hereafter set forth.
SECTION 2.
1. Add Section 13-126(C)(9) to read:
"9. Accessory apartments may be allowed by the Zoning Administra-
tor by a Minor Conditional Use Permit when they meet the criteria set forth
elsewhere in this Article."
2. Add Section 13-131 to read:
"ACCESSORY APARTMENTS
Accessory apartments shall meet the criteria specified in Section
65852.2 of the California Government Code and the following criteria:
A. One dwelling unit on the property shall be owner occupied. A
"Notice and Declaration of Land Use Restriction" to this effect shall be
signed and recorded prior to issuance of building permits for the acces-
sory apartment.
B.
The accessory apartment shall be
attached to
and clearly a
subordinate
part of the single-family dwelling.
In no case
shall it exceed
the lesser
of six hundred forty (640) square
feet in area
or 40% of the
primary unit.
C. Parking shall be provided as required elsewhere in this title."
3. Add Section 13-545(d) to read:
"Parking for Accessory Apartments. Accessory apartments attached
to single-family residences as provided for elsewhere in this Title and
accessory dwelling units approved pursuant.to Section 65852.1 of the Cali-
fornia Government Code shall be provided with at least two on-site parking
spaces in addition to parking required for the existing single-family
residence. The parking need not be covered. City of Costa Mesa Parking
Standards shall apply."
SECTION 3.
This Ordinance shall take effect and be in full force thirty (30) days
from and after the passage thereof, and prior to the expiration of fifteen

(15) days frau its passage shall be published once in the ORANGE COAST
DAILY PILOT, a newspaper of general circulation, printed and published in
the City of Costa Mesa or, in the alternative, the City Clerk may cause to
be published a summary of this Ordinance and a certified copy of the text
of this Ordinance shall be posted in the office of the City Clerk five (5)
days prior to the date of adoption of this Ordinance, and within fifteen
(15) days after adoption, the City Clerk shall cause to be published the
aforementioned summary and shall post in the office of the City Clerk a
certified copy of this Ordinance together with the naives of the members of
the City Council voting for and against the same.
