AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING A
MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS
IN THE AREA NORTH OF THE SAN DIEGO FREEWAY.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1.
1. On September 16, 1985, the City Council adopted Ordinance 85-25
as an urgency measure to prohibit issuance of building permits for proper-
ties north of the San Diego Freeway in the City of Costa Mesa;
2. The building permit moratorium is effective through and including
October 1, 1985, while a preliminary investigation is conducted into the
cause of severe cracking occurring in several homes in the area between
Fairview Road and Bear Street;
3. The City Council finds that properties west of Harbor Boulevard
are sufficiently distant from the area of concern that they need not be
subject to the building permit moratorium.
ACCORDINGLY, Ordinance No. 85-25 is amended to read as follows:
SECTION 2.
1. No building permits, with the exception of tenant improvements,
plumbing, mechanical, and electrical permits, shall be issued for proper-
ties located north of the San Diego Freeway and east of Harbor Boulevard
in the City of Costa Mesa so long as this ordinance is in effect.
2. This ordinance shall remain in effect through and including October
1, 1985, on which date the City Council will meet to review findings of a
preliminary investigation.
SECTION 3.
The City Council finds and declares that the protection and preserva-
tion of the public health, safety, and general welfare of the community
requires that this ordinance be adopted as an urgency measure pursuant to
Sections 36934 and 36937 of the California Goverment Code.
This ordinance is required as an urgency measure due to the current and
immediate threat to the structural integrity of residences and other struc-
tures in the north Costa Mesa area and the possible resulting physical harm
to people. In the event the damage is related to construction activities
in the area, the City Council desires not to exacerbate that damage by
authorizing additional construction activities.
SECTION 4.
This Ordinance shall take effect immediately after its passage, and
prior to the expiration of fifteen (15) days from its passage shall be pub-
lished once in the ORANGE COAST DAILY PILOT, a newspaper of general circu-
lation, printed and published in the City of Costa Mesa together with the
names of the members of the City Council voting for and against the same.
