HomeMy WebLinkAbout86-03 Relinquish to Orange County Regulation of Underground Storage Tanks Containing Hazardous MaterialsORDINANCE NO. 86-3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, TO RELINQUISH TO ORANGE COUNTY REGULATION OF UNDERGROUND STORAGE TANKS CONTAINING HAZARDOUS MATERIALS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa finds and declares as follows: 1. On July 16, 1984, the City Council adopted Ordinance No. 84-30 concerning regulation of the storage of hazardous substances in underground tanks and piping as authorized in Health and Safety Code Section 25282.. 2. -Since the adoption of Ordinance No. 84-30, Orange County has established an excellent, effective program which is available for applica- tion throughout the county, including. within the City of Costa Mesa. 3. It now appears that enforcement of the county's program could take place within Costa Mesa without there being any conflict or overlap- ping with the enforcement of the Unifo-rn Fire Code by the City's Fire Department. 4. It would be in the best interest of the public health, safety, and general welfare to relinquish regulation of such hazardous substances to Orange County. ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends Title 7 of the Costa Mesa Municipal Code as hereinafter set forth: SECTION 2. 1. Ordinance No. 84-30 is repealed. 2. Section 7-61 of Title 7 is repealed. 3. Sections 7-61 through 7-64 of Title 7 are reserved. 4. Resolution No. 84-95, establishing a fee for permits for under- ground storage of hazardous material, is repealed. SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days frcam and after the passage thereof, and prior to the expiration of fifteen (15) days frcdm its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this.Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
