HomeMy WebLinkAbout86-15 Rezoning Portion of Lot A of Banning Tract, in Rancho Santiago De Santa Ana, from C1 to CLORDINANCE NO. 86-15 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CHANGING THE ZONING OF A PORTION OF LOT A OF THE BANNING TRACT, IN THE RANCHO SANTIAGO DE SANTA ANA, FROM Cl TO CL. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. There is hereby placed and included in the CL Zone, that portion of real property at 2490 Harbor Boulevard, Assessor Parcel Number 141-491-11, situated in the City of Costa Mesa, County of Orange, State of California, to wit: That portion of Lot A of the Banning Tract, in the Rancho Santiago De Santa Ana, in the City of Costa Mesa, County of Orange, State of Cali- fornia, as shown on a map filed in Action 6385 in the Superior Court of California, in and for the County of Orange, being an action for partition entitled "Hancock Banning and others vs. Mary H. Banning", described as follows: Beginning at a point in the centerline of Harbor Boulevard South 0014180" West 200.00 feet from its intersection with the centerline of Fair Drive, as said intersection is shown on the map of Tract 2750, as per map recorded in Book 91, Pages 1 to 5 inclusive, of Miscellaneous Maps, in the office of the County Recorder of said County, said point being the Northwesterly corner of the land described in the deed to John David Ross recorded August 6, 1970, in Book 9367, Page 775 of Official Records; thence along the Northerly line of said land of Ross North 89059117" East 245.00 feet to a point on a line that is parallel with and distant Easterly 245.80 feet from the centerline of said Harbor Boulevard, said point being the most Northerly Southwesterly corner of the land described in the deed to Dave Ross Pontiac, Incor- porated, recorded August 6, 1970, in Book 9367, Page 772 of Official Records; thence along the Westerly line thereof North 0014100" East 150.00 feet to the Southerly line of Fair Drive, and the boundary of said Tract 2750; thence along the boundary of said Tract 2750, South 89059117" West 180.06 feet, more or less, to the beginning of a curve in said boundary concave Southeasterly having a radius of 15.00 feet; thence Southwesterly 23.50 feet along said curve through a central angle of 89045117" to the Westerly line of said Tract 2750; thence leaving said boundary and parallel with the centerline of said Fair Drive, South 89059117" West 50.00 feet to the centerline of said Harbor Boulevard; thence along said centerline South 0014100" West 135.06 feet to the point of beginning. EXCEPTING THEREFROM an undivided 40 percent interest in and to all oil and mineral rights, but without right of entry to the surface or to the sub -surface thereof to a depth of 500 feet of said land, as granted to Peoples Investment Corporation, a corporation, by instru- ment recorded February 14, 1958, in Book 4197, Page 173, Official Records of Orange County. ALSO EXCEPTING THEREFROM an undivided 60 percent interest in and to all oil and mineral rights, but without right of entry to the surface or to the sub -surface thereof to a depth of 500 feet of said land as granted to Palm Investment Corporation, a corporation, by instrument recorded February 14, 1958, in Book 4197, Page 177, Official Records of Orange County. Said land is included within the area shown on a map filed in the office of the County Recorder of said Orange County, in Book 31, Page 24 of Parcel Maps, in the office of the County Recorder of said County. A portion of said land is shown as Parcel "A" on a map filed in Book 40, Page 29 of Parcel Maps in the off ice of the County Recorder of said County. SECTION 2. Pursuant to the provisions of Section 13-79 of the Costa Mesa Municipal Code, District Map C-5 of the City of Costa Mesa, copies of which are on file in the office of the Planning Division, is hereby amended by the addition thereto of the R3 area described in Section 1 hereof. SECTION 3. This Ordinance shall take effect and be in full - force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to - 2 - be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
