AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, CONCERNING THE REGULATION
OF PARKS AND ATHLETIC FIELDS IN THE CITY OF COSTA
MESA.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa hereby finds
and declares as follows:
Conflicts have arisen between organizations and individuals desiring
to use City recreation. facilities, especially parks and playing fields,
which conflicts are not adequately dealt with by existing legislation.
Conflicts
have also arisen
between
groups or
athletic
teams
using
City parks and
nearby residents,
who are
disturbed
by noise
during
early
morning hours on weekends.
Conflicts have also arisen between groups or athletic teams using
City parks and nearby residents, who are disturbed by trash and litter left
on a facility or thrown onto adjacent property and the use of profane,
indecent, or insulting language.
Amendments to the Municipal Code provisions governing use of City
recreation facilities are needed to resolve the aforementioned conflicts
and to update ordinance provisions.
ACCORDINGLY, the Title 12 of the Costa Mesa Municipal Code is hereby
mended as follows:
SECTION 2.
1. Amend Section 12-18 (b) to read as follows:
"(b) No person shall disobey any reservation notice posted or
issued by the Department of Leisure Services concerning the use of any park
facility, site, tables, or other public accommodations therein."
2. Anend Section 12-20 (i) to read as follows:
"(i) Beg, or solicit contributions or subscriptions without a
permit from the City Council;"
3. Anend Section 12-20 (j) to read as follows:
"(j) Conduct any business including, but not necessarily limited
to, wholesale or retail provision or distribution of goods, commodities, or
services."
4. Amend Section 12-20 (k) to read as follows:
"(k) Climb upon any wall, fence, shelter, seat, building, struc-
ture, or construction;"
5. Pmmend Section 12-20 (1) to read as follows:
"Bring, land, or cause to descend or alight any aircraft, air-
ship, dirigible, balloon, parachute or other instrumentality, machine, or
apparatus for aviation or flight, except by permission of the Director of
Leisure Services or his designee;"
6. Amend Section 12-53 to read as follows:
"(a) Any lodge, society, social organization, sports league or
team, social club or other organization of persons having ten (10) or more
members desiring to resort to or use any park, square, avenue, grounds or
recreation center for a parade, picnic, game, or other purpose shall
obtain a permit from the Director of Leisure Services or his designee not
less than five (5) days nor more than ten (10) days prior to such use.
The Director and other personnel of the Department of Leisure Services may
take all reasonable measures to apportion the use of parks and other

recreational facilities fairly among individuals and groups desiring to use
them.
"(b) The Director of Leisure Services may refuse to issue per-
mits for use of any facility during certain times when, in his judgment,
such use would unreasonably disturb the peace and quiet of residents in the
vicinity.
"(c) Whenever the Director of Leisure Services determines that a
group or organization has abused.the privileges of a permit issued pursuant
to this section by intentionally violating any of the rules, regulations or
policies printed on the group reservation form, or the time restrictions of
the permit, or by engaging in disorderly conduct as defined in this Title,
the Director may refuse to issue any permit to such group or organization
for use of any or all parks and recreation facilities, for a period not to
exceed ninety (90) days for each such offense. Before making such deter-
mination, the Director shall allow interested persons an opportunity to
submit relevant information either orally or in writing, and the Director
shall give notice of his decision by mail. The decision of the Director
may be appealed to the City Council by any interested_ person within seven
(7) days of the date on which the notice of the decision, addressed to the
groups or organizations affected, is deposited in the mail; provided, how-
ever, that the decision shall remain in effect while the appeal is pending."
7. Repeal Section 12-54.

This ordinance shall take effect and be in full force thirty (30) days
from and after the passage thereof, and prior to the expiration of fifteen
(15) days from its passage shall be published once in the ORANGE COAST
- 3 -
DAILY PILOT, a newspaper of general circulation, printed and published in
the City of Costa Mesa or, in the alternative, the City Clerk may cause to
be published a summary of this Ordinance and a certified copy of the text
of this Ordinance shall be posted in the office of the City Clerk five (5)
days prior to the date of adoption of this Ordinance, and within fifteen
(15) days after adoption, the City Clerk shall cause to be published the
aforementioned sumary and shall post in the office of the City Clerk a
certified copy of this Ordinance together with the names of the members of
the City Council voting for and against the same.

going Ordinance No. 86-19, was introduced and considered section by section
at a regular meeting of said City Council held on the 21st day of July,
1986, and thereafter passed and adopted as a whole at a regular meeting of
said City Council held on the 4th day of August, 1986, by the following
roll call vote:
