HomeMy WebLinkAbout86-20 Urgency Ordinance Reenacting Parking Permit Program for Residential NeighborhoodsORDINANCE NO. �0 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, REENACTING PARKING PERMIT PROGRAM FOR RESIDENTIAL NEIGHBORHOODS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa hereby finds and declares that there is a current and immediate threat to the public health, safety and general welfare as follows: Section 10-221.9 calls for the automatic repeal of the City's permit parking ordinance after December 31, 1985, a date which has already occurred. Due to this fact, it is no longer possible to enforce the posted parking restrictions in the vicinity of the Pacific Amphitheatre which serve to pro- hibit users of institutional and recreational development from parking in City neighborhoods. This could result in a severe shortage of vehicle parking spaces in such neighborhoods, noise, litter and other disturbances caused by amphitheatre patrons parking in residential neighborhoods, and traffic circu- lation problems by large numbers of cars using residential streets. In order to alleviate this problem and to insure the public health, safety and general welfare, it is necessary to reenact Article 3, Chapter XI, Title 10, Costa Mesa Municipal Code, except for deleting Section 10-221.9. The City Council finds and declares that the protection of the public health, safety and general welfare requires that this ordinance be adopted as an urgency measure pursuant to the California Government Code. The reasons in support of the necessity of an urgency measure are as follows: Commercial recreation activities at the Pacific Amphitheatre and the Orange County Fairgrounds have occurred and are scheduled to occur throughout the summer of 1986. Existing permit parking restrictions must remain in force in order to prevent the detrimental impacts mentioned above and immediate enforcement authority is needed for such restrictions to be effective. Routine adoption of this ordinance would result in inability to enforce the existing posted parking regulations until such time that the Ordinance could routinely be adopted. SECTION 2. Accordingly, the City Council of the City of Costa Mesa hereby amends the Costa Mesa Municipal Code by reenacting Article 3, Chapter XI of Title 10 of the Costa Mesa Municipal Code, but deleting Section 10-221.9. SECTION 3. This Ordinance shall take effect and be in full force immediately from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage, shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
