AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, CONCERNING THE
LOCATION AND TREATMENT OF SATELLITE DISH
ANTENNAS.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1.
1. The City Council finds and declares as follows:
a. The Federal Camunications Commission (FCC) released new rules
regarding regulation of satellite dish antennas which became
effective March 14, 1986, that necessitate a revision of the
City's Ordinance.
b. Satellite dish antennas are more visually obtrusive than other
pole, array, or tower type antennas as illustrated in Attach-
ment "A".
c. Satellite dish antennas may adversely impact abutting resi-
dential uses which would be subject to their visual obtrusive-
ness on a daily basis.
d. An ordinance is needed to address the General Plan goal "to
establish development policies which will create and maintain
an aesthetically pleasing and functional urban envirormlent and
minimize impacts on existing physical and social resources"
by establishing standards and/or procedures to mitigate poss-
ible negative effects on abutting residential properties.
ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends
Title 13 of the Costa Mesa Municipal Code as hereinafter set forth:
SECTION 2.
1. Delete Section 13-129.8 regarding screening satellite antennas.
2. Amend Section 13-143.2 by deleting satellite antennas as follows:
"2. All carports, trash enclosures, and mechanical equipment, such
as air conditioning compressors, duct work, and vents shall be
screened fran view frau public rights-of-way and adjacent proper-
ties."
3. Amend Section 13-236.2 by deleting satellite antennas as follows:
"2. All trash containers and mechanical equipment, such as air
conditioning compressors, duct work, and vents shall be screened
from public rights-of-way and adjacent properties."
4. Amend Section 13-313 regarding height limits for antennas as
follows:
"Building height limitations shall not apply to antennas which do
not require building permits nor to satellite antennas."
5. Add Section 13-353 to list satellite antennas in residential zones
and nonresidential zones adjacent to residential zones as a use
which the Zoning Administrator may allow by a Minor Conditional
Use Permit, as follows:
"Section 13-353. Satellite Antennas.
1. Satellite antennas may be allowed in residential zones and
nonresidential zones adjacent to residential zones as minor
conditional use permits.
6. Amend Section 13-420(j) deleting general screening requirements
for satellite antennas as follows:
"(6) All trash containers and mechanical equipment, such as air
conditioning compressors, duct work, and vents shall be screened
from public rights-of-way and adjacent properties.
SECTION 3.
This Ordinance shall take effect and be in full force thirty (30) days
from and after the passage thereof, and prior to the expiration of fifteen
(15) days from its passage shall be published once in the ORANGE COAST
DAILY PILOT, a newspaper of general circulation, printed and published in
the City of Costa Mesa or, in the alternative, the City Clerk may cause to
be published a summary of this Ordinance and a certified copy of the text
of this Ordinance shall be posted in the office of the City Clerk five (5)
days prior to the date of adoption of this Ordinance, and within fifteen
(15) days after adoption, the City Clerk shall cause to be published the
aforementioned summary and shall post in the office of the City Clerk a
certified copy of this Ordinance together with the names of the members of
the City Council voting for and against the same.
