AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, MAKING AN ORGANIZATIONAL
CHANGE CONCERNING THE OFFICE OF THE CITY CLERK.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa hereby finds and
.,Aeclares that it wishes to make an organizational change in the City staff
by placing the City Clerk's office and functions under the management and
control of the City Manager, and by ending the appointment of the City
Clerk by the City Council.
ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends
Title 2 of the Costa Mesa Municipal Code as hereafter set forth:
SECTION 2.
1. Section 2-3 is amended to read as follows:
"Section 2-3. Appointment of city treasurer and city attorney; terms
of office; removal.
The city council shall appoint a city treasurer and a city attorney
to serve and hold office at and during the pleasure of the city council.
Removal of these city officers from their respective posts shall be done
in the same manner as provided for in section 2-135 through and including
section 1-139 of this Code."
2. Section 2-115 is amended to read as follows:
"Section 2-115. Control and direction of employees.
It shall be the duty of the city manager and he shall have the power
to control, order and give directions to all heads of departments, sub-
ordinate officers and employees of the city, except the city attorney and
the city treasurer so far as his functions as treasurer are concerned; to
transfer employees fran one department to another; and to _consolidate or
combine offices, positions, departments or units under his direction."
3. Section 2-116 is amended to read as follows:
"Section 2-116. Appointment, removal, discipline of employees.
It shall be the duty of the city manager and -he shall have the power
to appoint, pranote, discipline, demote and remove any officers and
employees of the city, except the city attorney and the city treasurer."
4. Section 2-215(b) is amended to read as follows:
"-(b) The city manager, city attorney, and city treasurer."
5. Section 2-224 is amended to read as follows:
"Section 2-224. Applicability to certain exempt positions.
The provisions of the personnel rules relating to attendance and
leaves shall apply to the city manager."
SECTION 3. This Ordinance shall take effect and be in full force
thirty (30) days frau and after the passage thereof, and prior to the
expiration of fifteen (15) days from its passage shall be published once in
the ORANGE COAST DAILY PILOT, a, newspaper of general circulation, printed
and published in the City of Costa Mesa or, in the alternative, the City
Clerk may cause to be published a summary of this Ordinance and a certified
copy of the text of this Ordinance shall be posted in the office of the
City Clerk five (5) days prior to the date of adoption of this Ordinance,
and within fifteen (15) days after adoption, the City Clerk shall cause to
be published the aforementioned summary and shall post in the office of
the City Clerk a certified copy of this Ordinance together with the names
of the members of the City Council voting for and against the same.
