HomeMy WebLinkAbout87-02 Revise Definitions and Clarify Flood-Proofing Standards in Flood Hazard AreaORDINANCE NO. 87-,t AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING ARTICLE 17-1/2, TITLE 13 OF THE COSTA MESA MUNICIPAL CODE, TO REVISE DEFINITIONS AND CLARIFY FLOOD - PROOFING STANDARDS IN THE FLOOD HAZARD AREA. The City Council of the City of Costa Mesa does hereby ordain as follows: SECTION 1: The City Council of the City of Costa Mesa hereby finds and declares as follows: A. That the Federal Emergency Management Agency published a final rule in the Federal Register on August 25, 1986, that revises National Flood Insurance Program (NFIP) floodplain management criteria. B. That NFIP criteria require that the City revise its floodplain management regulations by April 1, 1987 to continue eligibility for par- ticipation in NFIP. Accordingly, the City Council of the City of Costa Mesa herewith amends Article 17-1/2, Title 13 as hereafter set forth: SECTION 2: 1. Amend Section 13-258, definitions, by replacing "habitable floor" with "lowest floor", replacing "mobile home" with "manufactured home", replacing "new mobile home park or subdivision" with manufactured home park or subdivision", and adding "start of construction" as follows: (16) Lowest floor: The lowest floor of the lowest enclosed area (including basement). An unfinished or flood resistant enclosure, usable solely for parking of vehicles, building access or storage, in an area other than a basement area, is not considered a building's lowest floor, provided that such enclosure is not built so as to render the structure in violation of the applicable non -elevation design requirements of this ordinance. (19) Structure: Anything constructed or erected requiring a fixed location on the ground or attached to something having a fixed location on the ground except business signs and other improvements of a minor character. For floodplain management purposes, "structure" means a walled and roofed building, including a gas or liquid storage tank that is principally above ground, and includes a manufactured home. (21) Manufactured home: Any structure that is transportable in one or more sections, built on a permanent chassis, and designated to be used with or without a permanent found- ation when connected to the required utilities. For flood plain management purposes the term "manufactured home" also includes park trailers, travel trailers, and other similar vehicles placed on a site for greater than 180 consecutive days. For insurance purposes the term "manufactured hare" does not include park trailers, travel trailers, and other similar vehicles. (22) Manufactured hone park or subdivision: Any parcel (or contiguous parcels) of land divided into two (2) or more manufactured hone lots for rent or sale. (23) Start of Construction: the date the building permit was iss- ued, provided the actual start of construction, repair, reconstruction, placement, or other improvement was within 180 days of the permit date. The actual start means either the first placement of permanent construction of a structure on a site, such as the pouring of slab or footings, the in- stallation of piles, the construction of columns, or any work beyond the stage of excavation; or the placement of a manufactured home on a foundation. Permanent construction does not include land preparation, such as clearing, grading and filling; nor does it include the installation of streets and/or walkways; nor does it include excavation for a base- ment, footings, piers, or foundations or the erection of temporary forms; nor does it include the installation on the property of accessory buildings, such as garages or sheds not occupied as dwelling units or not part of the main structure. 2. Amend Secion 13-261, Procedures and Development Standards, by changing the term "lowest habitable floor" to "habitable floor", adding a provision regarding fully enclosed areas below the base flood elevation, adding a provision regarding elevating or design- ing mechanical and utility equipment to prevent water from enter- ing or accumulating within the equipment, changing the term "mobile home" to "manufactured hone", and deleting the exemption for exist- ing "mobile home parks" as follows: (2)(a) Proposed elevation in relation to mean sea level, of the lowest floor (including basement) of all structures; in Zone AO elevation of existing and proposed elevation of lowest floor of all structures. (4)(c) New construction and substantial improvement of any struc- ture shall have the lowest floor, including basement, elevated to or above the base flood elevation. Nonresiden- tial structures may meet the standards in subsection 13- 261(4)(e). Upon completion of the structure, the eleva- tion of the lowest floor including basement shall be certi- fied by a registered professional engineer or surveyor and provided to the development services director. (4)(f) For all new construction and substantial improvements, fully enclosed areas below the lowest floor that are subject to flooding shall be designed to automatically equalize hydro- static flood forces on exterior walls by allowing for the entry and exit of floodwaters. Designs for meeting this re- quirement must either be certified by a registered profes- sional engineer or architect or must meet or exceed the fol- lowing minimum criteria: A minimum of two openings having a total net area of not less than one square inch for every square foot of enclosed area subject to flooding shall be provided. The bottom of all openings shall be no higher than one foot above grade. Openings may be equipped with screens, louvers, or other coverings or devices provided that they permit the automatic entry and exit of floodwaters. (5)(c) Electrical, heating, ventilation, plumbing, and air-condi- tioning equipment and other service facilities shall be de- signed and/or located so as to prevent water from entering or accumulating within the components during conditions of flooding. (7) Construction standards for manufactured homes and manufactured home parks and subdivisions. (a) All manufactured homes and additions to manufactured homes shall be anchored to resist flotation, collapse, or lateral movement by one of the following methods: 1. By providing an anchoring system designed to withstand horizontal forces of fifteen (15) pounds per square foot and uplift forces of nine (9) pounds per square foot; or 2. By anchoring of the units, designed to be in compliance with the Department of Housing and Community Development Manufactured Homes Construction and Safety Standards (Title 25, California Administrative Code, Installation Regulations). (b) The following standards are required for (1) newly placed manufactured homes, (2) new manufactured home parks or subdivisions, (3) expansions to existing manufactured hone parks or subdivisions, and (4) repair, reconstruction, or improvements to existing manufactured hone parks or subdi- visions that equal fifty (50) percent or greater of the value of the streets, utilities, and pads, before the re- pair, reconstruction, or improvements commenced: 1. Adequate surface drainage and access for a hauler shall be provided. 2. All manufactured hones shall be placed on pads or lots elevated on compacted fill or on pilings so that the lowest floor of the manufactured hone is at or above the base flood level. If elevated on pilings: a. The lots or pads shall be large enough to accommo- date steps; b. The pilings shall be placed in stable soil no more than ten (10) feet apart; and c. Reinforcement shall be provided for pilings more than six (6) feet above ground level. (c) Written certification of compliance with the standards con- tained in this section shall be provided by the installer of the manufactured hone, the developer of the manufactured home park or subdivision, or the state agency responsible for regulating placement. Such certification shall be maintained on file by the development services department for flood insurance purposes. (d) No manufactured home shall be placed in a floodway or the FP -I District. SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
