HomeMy WebLinkAbout87-18 Amending Article 17-1/2, Title 13, to Clarify Floodproofing Standards in Flood Hazard AreaORDINANCE NO. 87-/R' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING ARTICLE 17-1/2, TITLE 13 OF THE COSTA MESA MUNICIPAL CODE, TO CLARIFY FLOODPROOFING STANDARDS IN THE FLOOD HAZARD AREA. The City Council of the City of Costa Mesa does hereby ordain as follows: SECTION 1: The City Council of the City of Costa Mesa hereby finds and declares as follows: A. That the Department of Water Resources (DWR) under contract with the Federal Emergency Management Agency (FEMA) reviewed the City's Flood- plain Ordinance and found four sections that were not in canpliance with National Flood Insurance Program (NFIP) floodplain management criteria. B. That NFIP criteria require that the City revise its floodplain management regulations to continue eligibility for participation in NFIP. Accordingly, the City Council of the City of Costa Mesa herewith amends Article 17-1/2, Title 13 as hereafter set forth: SECTION 2: Amend Section 13-2611 Procedures and Development Standards by adding a requirement that all development proposals be reviewed to assure that all other required State and Federal permits have been obtained, adding a requirement that adequate drainage paths be provided for structures on slopes in zones AH and A0, changing the elevation requirement in zone AO frau one (1) foot above the crown of the nearest street to two (2) feet above the highest adjacent grade, and deleting anchoring standards which apply to resisting wind forces instead of resisting hydraulic forces as follows: (1)(b) Review the proposed development to assure that all other re- quired State and Federal permits have been obtained. (1)(c) Review of all permits to determine that the site is reasonably safe from flooding. I (1)(d) Review of all development permits to determine if the proposed development adversely affects the flood carrying capacity of the area of special flood hazard. For purposes of this article, "adversely affects" means that the cumulative effect of the proposed development when combined with all other existing and anticipated development will increase the water surface elevation of the base flood more than one foot at any point. (4)(d) New construction and substantial improvement of any structure in Zone AO shall have the lowest floor, including basement, elevated to or above the depth number specified on the FIRM. If there is no depth number on the FIRM, the lowest floor, including basement, shall be elevated at least two feet above the highest adjacent grade. Nonresidential structures may meet the standards in subsection 13-261(4)(e). Upon completion of the structure, a registered professional engineer shall certify that the eleva- tion of the structure meets this standard and such certification shall be provided to the Development Services Director. (4)(f) Require adequate drainage paths around structures on slopes to guide flood waters around and away from proposed structures within Zones AH and AO. (7)(a) All manufactured homes and additions to manufactured homes shall be anchored to resist flotation, collapse, or lateral movement. SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the Same_ PASSED AND ADOPTED this d ATTEST: City Clerk of the City of CoAa Mesa APPROVED AS TO FORM: City torney STATE OF CALIFORNIA ) COUNTY OF ORANGE ) ss.
