HomeMy WebLinkAbout87-20 Amending Sections of Code Regarding Residential Density Calculations in R2, R3, and R4 ZonesORDINANCE NO. 87-20 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING SECTIONS 13-136(A)(2), 13-148(A)(2) AND 13-174(A)(2) OF THE COSTA MESA MUNICIPAL CODE REGARDING RESIDENTIAL DENSITY CALCULATIONS IN THE R2, R3 AND R4 ZONES. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council finds and declares as follows: a. Residential densities in the R2, R3 and R4 zones are calculated on the basis of the developable land area of residential parcels. b. The calculation of allowable densities on many parcels results in fractional dwelling units because of the varied size of residential parcels. c. It is desirable to allow fractional units to be rounded up to the next higher full dwelling unit if actual number of total units can be accom- modated without adversely impacting the surrounding land uses and parcels. d. The existing method of calculating residential densities does not contain sufficient criteria to ensure that the rounding -up of fractional units would not adversely impact surrounding land uses and parcels. Accordingly, the City Council of the City of Costa Mesa hereby amends Title 13 of the Costa Mesa Municipal Code as hereinafter set forth: SECTION 2. 1. Amend Section 13-136(A)(2) to read as follows: (2) One (1) dwelling unit for each three thousand (3,000) square feet of land remaining after all required dedications have been made. Fractions equal to or greater than one-half (0.5) may be rounded up by approval of a Minor Conditional Use Per- mit from the Zoning Administrator. Such Minor Conditional- Use Permit may be granted if all the following conditions are met: a. All other development standards are met without Variances; b. The total number of units does not exceed that allowed by by City of Costa Mesa General Plan; and c. The number of units to be built does not exceed 105% of the number of units (including fractional units) allowed before rounding up, in accordince with the following formula: 1.05a n is less than or equal to f Where n =number of units to be built a = the parcel area (square feet) after dedication f-= number of square feet per unit required by the zoning standard (i.e. 3,000 sq.ft.`in R2 zone) Approval of such minor Conditional Use Permit shall not be final until.ratified by the Planning Ccomission. For this purpose, the matter shall be placed on the Consent Calendar of the first regular Planning Camnission meeting which follows approval by.the Zoning Administrator by ten -(10) or more days. 2. Amend Section 13-148(A)(2) to read as follows: (2) One (1) dwelling unit for each two thousand (2,000) square feet of land remaining after all required dedications have been made. Fractions equal to or greater than one-half (0.5) by approval of a Minor Conditional Use Per- mit frau the Zoning Administrator. Such Minor Conditional Use Permit may be granted.if all the following conditions are met: a. All other development standards are met without Variances; . The total number of units does not exceed that allowed by by City of Costa Mesa General Plan; and c. Amend Section 13-174(A)(2) to read as follows: (2) One (1) dwelling unit for each one thousand five hundred (1,500) square feet feet of land remaining after all required dedications have been made. Fractions equal to or greater than one-half (0.5) may be rounded up by approval of a Minor Conditional Use Permit from the Zoning Administrator. Such Minor Conditional Use Permit may be granted if all the following conditions are met: a. All other development standards are met without Variances; b. The total number of units does not exceed that allowed by by City of Costa Mesa General Plan; and c. The number of units to be built does not exceed 105% of the number of units (including fractional units) allowed before rounding up, in accordince with the following formula: STATE OF CALIFORNIA ) COUNTY OF ORANGE ) ss.
