HomeMy WebLinkAbout87-22 Adopting Various 1985 Editions of Uniform Codes, and 1987 Edition of Uniform Codesr ,r ORDINANCE NO. 87- 02 o, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,,CALIFORNIA, ADOPTING BY REFERENCE THE 1985 EDITIONS OF THE'UNIFORM BUILDING CODE, THE UNIFORM ADMINISTRATIVE'CODE, THE UNIFORM HOUSING CODE, THE UNIFORM -SIGN CODE' THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, THE -UNIFORM SOLAR ENERGY CODE, THE UNIFORM PLUPBING CODE IN- CLUDING APPENDICES A, B, C,' D, H, AND I, THE UNI- FORM MECHANICAL CODE INCLUDING APPENDICES A, B AND C AND THE 1987 EDITION OF THE NATIONAL:ELEC- TRICAL CODE TOGETHER WITH THE UNIFORM ADMINISTRA- TIVE CODE PROVISIONS FOR THE NATIONAL ELECTRICAL CODE (1987 EDITION): AND CERTAIN.Ni0DIFICATIONS AND AMENDMENTS TO SAID CODES INCLUDING THE 1987 ACCUMULATIVE SUPPLEMENTS) THERETO. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The City Council of the City of Costa Mesa hereby finds and declares as follows: 1.. That the City Council of the City of Costa Mesa adopted by refer- ence the 1979 Editions of the. Uniform Building Code, the Uniform Housing Code, the Uniform Plumbing Code,. the 1978 Edition of the National Electrical Code and the Uniform Wiring Code of the City of Costa Mesa with amendments to the National Electrical Code by adoption of Ordinance No. 82-13; and 2. That the International Conference of Building Officials has pre- pared the 1985 Editions of the Uniform Building Code including the Appen- dices thereto, the 1987 Accumulative Supplement, the Uniform Administrative Code, the Uniform Housing Code, the.Uniform Sign Code, the Uniform Code for the Abatement of Dangerous Buildings, the Uniform Solar Energy Code, and has prepared by.joint-effort with the International Association of Plumbing and Mechanical Officials, the 1985 Editions of the Uniform Plumbing Code includ- ing Appendices A, B, C, D, H and I and the Uniform Mechanical Code including Appendices A, B and C; and 3. That the National Fire Protection Association has prepared the 1987 dition of the National Electrical Code together with the Uniform Adminis- trative Code provisions for the National Electrical Code; and 4. That the adoption of the new Code editions as noted herein is nec- essary to provide the most current and comprehensive means to regulate the alteration, area, construction, conversion, demolition, enlargement, equip- ment, erection, height, maintenance, moving, occupancy, removal, repair, and use of all buildings and structures in the City of Costa Mesa, and further provides for collection of fees to defray the cost of administering and enforcing the State Building Codes at the local level, and for penalties for violation of the Codes. ACCORDINGLY, the City of Costa Mesa herewith amends Title 5 of the Costa Mesa Municipal Code as hereafter set forth. SECTION 2: 1. Amend Section 5-1 to read: "Sec. 5-1. Uniform Codes adopted. Those certain documents, one (1) copy of each which is on file in the office of the City Clerk, being identified as the Uniform Building Code 1985 Edition, including the Appendix thereto as amended [including the gen- eral fire -resistive assemblies listed in the Fire Resistance Design Manual, 1981 Edition, published by the Gypsum Association as referenced in Tables Nos. 43-A, 43-B, 43-C and Appendix Chapter 35 of the Uniform Building Code, 1985 Edition] the Uniform Administrative Code 1985 Edition; the Uniform Housing Code 1985 Edition; the Uniform Sign Code 1985 Edition; the Uniform Code for the Abatement of Dangerous Buildings 1985 Edition as published by the International Conference of Building Officials; the Uniform Building Code Standards, 1985 Edition, including (i) Structural Welding Code - Reinforcing Steel, AVE D1.4-79 (U.B.C. Standard No. 26-8); (ii) Structural Welding Code - Steel, ANSI/AWS D.1 1-84 (U.B.C. Standard No. 27-6); Struc- -2- tural Welding Code - Sheet Steel, ANSI/AWS D1.3-81 (U.B.C. Standard No. 27-16) published by the American Welding Society, Inc.; and (iv) Standard for the Installation of Sprinkler Systems, NFPA 13-1980, published by the National Fire Protection Association (U.B.C. Standard No. 38-1), as modi- fied or amended in the Uniform Building Code Standards as published by the International Conference of Building Officials; the Uniform Solar Energy Code 1985 Edition as published by the International Association of Plumb- ing and Mechanical Officials; the Uniform Plumbing Code 1985 Edition in- cluding Appendices A, B, C, D, H and I and the Uniform Mechanical Code 1985 Edition including Appendices A, B and C as jointly published by the International Association of Plumbing and Mechanical Officials and the International Conference of Building Officials are hereby adopted as the Building Code'of the City." 2.' Amend Section 5-1.2 to read: "Sec. 5-1.2. Development Services Director. All references to the "Building and Safety Director" or the "Build- ing Official" in Title 5, Building and Structures, of the Costa Mesa Muni- cipal Code shall be deemed to mean the "Development Services Director, or his designee." 3. Amend Section 5-2 to read: "Sec. 5-2. Building Code Section 304 amended. Section 304(a) of the Uniform Building Code is hereby amended by adding the following sentence to Paragraph (a): 'In R1 zones no building permit fees shall be required for the construction of fallout shelters.'" 4. Section 5-3 is hereby deleted. 5. Section 5-4 Building Code Section 420 amended. Section 420 of the Uniform Building Code is amended by adding a -3- new definition to -read as follows: "Swimming pool is any, body of -water, created by artificial means, any portion of which exceeds eighteen (18) inches in depth, which is used or intended to be used for swimming." 6.. Section 5 -5 -is -hereby deleted. 7. Amend Section 5-6 to read: "Sec. 5-6. Building Code Section 3802 amended. The following amendment is made to .the Uniform Building Code by adding a Subsection (h) to Section 3802 which shall read as follows: '(h) Standard automatic fire extinguishing systems shall be in- stalled and maintained. in operable condition as specified in this chapter in the following locations: 1. In Group B, Division 2 occupancies when there is over twelve thcusand.(121'000) square feet in a single floor area, or the structure is more than two stories in height. 2. .Throughout parking garages over six thousand (6,000) square feet in area, except open parking garages as defined .in Sec- tion 709,(b). -3. Throughout bowling alleys - aver six thousand (6,000) square feet in area. 4. Throughout restaurants over four thousand (4,000) square feet in area. 5. Throughout all buildings used as places of public assembly havinga stage. 6. Throughout all buildings having a place of public assembly above the first floor with an occupant load of more than fifty (50). 7. Throughout all buildings with usable floor area that is more -4- than fifty-five feet (55') above grade." 8. Section 5-8 is hereby deleted. 9. Amend Section 5-12 to read as follows: "Sec. 5-12. Refund of fees. Refund of any fee for plan review or building, plumbing, electri- cal, mechanical, or other permit, paid by the applicant to the City shall be made as provided in Section 304(f) of the Uniform Building Code 1985 Edition. 10. Section 5-13 is hereby deleted. 11. Section 5-14 is hereby deleted. 12. Section 5-16 is hereby deleted. 13." Amend Section 5-17 to read as follows: "Sec. 5-17. Fire -retardant roof coverings. Section 1704 of the Uniform Building Code is hereby amended to read as follows: "Notwithstanding any provision of this Building Code, the roof covering of any building hereinafter constructed, regardless of the type or occupancy classification, including any reroofing of any existing building, shall be of noncombustible or fire -retardant construction having a Class C rating. "The building permit fee for reroofing shall be based upon the val- uations found in Table No. 3-A of the Uniform -Building Code, 1985 Edition. "A separate permit shall not be required for a roof covering which involves a totally new building or structure for which a building permit has been properly issued. Classification by the installer, as required in this section, shall be filed with the Building Division prior to final building inspection. "For purposes of this section, Chapter 32, and Chapter 32 of .the Appendix, 'original area' shall mean that existing roof area before the -5- addition, repair or replacement. The existing'roof.area shall be considered as a value of one hundred (100) percent. "Any roof which is., added to, repaired, or replaced in the amount of fifty (50) percent or more of the original area shall be replaced in its entirety with roof covering in conformance with this section. Any roof that is added to, repaired, or replaced in the mount of less than ten (10) per- cent is exempt and may have a roof covering of the sane rating as the balance of the original roof. "The roof cover installer shall certify in writing to the Develop- ment Services Director, or his designee, that he has installed the products required by this section in accordance with the provisions of this code. If requested by the owner upon receipt of the certification from the in- staller, the Development Services Director, or his designee, may issue .a certificate of completion to,the owner of the property. "This Section 5-17 shall be applicable to all buildings and strums tures within the City boundaries." 14. Section 5-18 is hereby deleted. 15. Section 5-19 is hereby deleted. 16. Section 5-20 is hereby deleted. 17. Section 5-21 is hereby deleted. 18. Section 5-22 is hereby deleted. 19. Section 5-23 is hereby deleted. 20. ''Section 5-24 is hereby deleted. 21. Section 5-25 is hereby deleted. CHAPTER II. E•FCTRTCITY 1. Section 5-27 is hereby deleted. CHAPTER III. PLUMBING 1. Section 5-41 is.hereby deleted. -6- 2. Section 5-47 is hereby deleted. 3. Section 5-48 is hereby deleted. 4. Section 5-50 is hereby deleted. 5. Section 5-51 is hereby deleted. 6. Section 5-52 is hereby deleted. CHAPTER V. MOVING OR RELOCATION OF BUILDINGS AND STRUCTURES ARTICLE 1. IN GENERAL 1. Amend Section 5-96 to read: "Section 5-96. Appeal procedures. Any finding, determination or decision of the respective City officials or Cm -mission assigned to oversee and enforce the provisions of this chapter shall be final and conclusive, unless any person aggrieved by such finding, determination or decision shall have filed, within ten (10) days after same, a written appeal to the City Council pursuant to Costa Mesa Municipal Code, Title 2, Chapter IX, commencing with Section 2-300. SECTION 3. That Ordinance 82-13 of the City of Costa Mesa entitled "AN ORDINANCE OF THE CITY OQUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING BY REFERENCE THE 1979 EDITIONS OF THE UNIFORM BUILDING CODE, THE UNIFORM HOUSING CODE, THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, THE UNIFORM SOLAR ENERGY CODE AND THE UNIFORM PLUMBING CODE INCLUDING APPENDICES A, B, Cr D, G, H, AND I, AND THE 1976 EDITION OF THE UNIFORM MECHANICAL CODE INCLUDING APPENDICES A, B, AND C AND THE 1978 EDITIONS OF THE NATIONAL ELECTRICAL CODE AND THE UNIFORM WIRING CODE AND CERTAIN MODIFICATIONS AND AMENDMENTS TO SAID CODES" and all other ordin- ances or parts of ordinances in conflict herewith are hereby repealed.
