HomeMy WebLinkAbout88-21 Solicitation of Employment, Business, or Contributions from Public Streets and HighwaysORDINANCE NO. 88-21 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, RELATING TO SOLICITATION OF EMPLOYMENT, BUSINESS, OR CONTRIBUTIONS FROM PUBLIC STREETS AND HIGHWAYS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa does hereby find and declare as follows: WHEREAS, persons are gathering daily on public streets and sidewalks at various loctions in the City for the purpose of obtaining employment by approach- ing potential employers who drive to the sites in motor vehicles; and WHEREAS, this practice is causing a host of problems involving traffic safety and congestion, pedestrian obstruction and harassment, among others, when such persons approach the vehicles to talk with the occupants and get into the vehicles; and WHEREAS, potential employers contribute to this problem by regularly driving to these locations and stopping in the street to pick up workers; and WHEREAS, similar problems are caused when persons enter upon a street or highway to solicit business or contributions from occupants of vehicles temporarily stopped; ACCORDINGLY, the City Council of the City of Costa Mesa does hereby enact Chapter XIX of Title 10 of the City of Costa Mesa Municipal Code as set forth below. SECTION 2. CHAPTER XIX. SOLICITATION OF EMPLOYMENT, BUSINESS, OR CONTRIBUTIONS FROM STREETS. Section 10-354. Solicitation from Streets Prohibited. (a) It shall be unlawful for any person to stand on a street or highway and solicit, or attempt to solicit, employment, business, or contributions from an occupant of any motor vehicle. For purposes of this section, street or high- way shall mean all of the area dedicated to public use for public street purposes and shall include, but not be limited to, roadways, parkways, medians, alleys, sidewalks, curbs, and public ways. (b) It shall be unlawful for any person.to stop, park or stand a motor vehicle on a street or highway fran which any occupant attempts to hire or hires for employment another person or persons. SECTION 3. This Ordinance shall take effect and be in full force and effect thirty (30) days from and after its passage and, before the expiration of fifteen (15) days after its passage, shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation printed and published in the City of Costa Mesa, or, in the alternative, the City Clerk may cause to be published a surTmary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adop- tion, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
