HomeMy WebLinkAbout89-09 Concerning the Order of Business at Council MeetingsORDINANCE NO. 89-9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CONCERNING THE ORDER OF BUSINESS AT COUNCIL MEETINGS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council finds and determines as follows: 1. The order of business and times for City Council meetings has been revised several times to accommodate the preferences of the public and the Council Members and is likely to be changed again in the future. 2. It is needlessly cumbersome and time-consuming to amend the Munic- ipal Code whenever it is necessary or desirable to change the order of business, since the same purpose can be accomplished faster and more easily by removing the specification of the order of business from the Municipal Code and placing it in a Council resolution. ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends Title 2 of the Costa Mesa Municipal Code as hereinafter set forth: SECTION 2. Revise Title 2 to read as follows: 1. "Section 2-38. Regular Meetings. The city council shall hold regular meetings in the council chambers of the city hall, 77 Fair Drive, Costa Mesa, or such other place as designated by the city council. The dates and times will be set by council resolution. If by reason of fire, flood or other emergency it shall be unsafe to meet in the city hall, the meetings may be held for the duration of the emergency at such other places as are designated by the mayor, or, if he should fail to act, by three (3) members of the city council. When the day for any regular meeting falls on a holiday, Christ- mas hristmas Eve or New Year's Eve, such meetings shall be held at the same hour and place on the next succeeding day not a holiday or such other time as designated by the city council." 2. "Section 2-40. Study Sessions. (a) The city council shall hold regular study session meetings in the fifth floor conference room of the city hall to hear reports from the staff and to review, discuss, and debate matters of interest to the city, except that such sessions may be can- celled by the city manager, with the concurrence of the city council if not needed. The dates and times of these study ses- sions will be set by council resolution. Regular study session meetings shall also be held one hour preceding other regular meet tings in the conference room adjoining the city council chambers for the purpose of receiving and reviewing last-minute additions to the staff reports on items on the agenda for that evening's meeting and related matters. The mayor may also designate addi- tional study sessions from time to time, notice to be given in the same manner as for special meetings of the council. (b) No official action shall be taken at a study session. The verbal participation of the public in study sessions will be governed by rules set by council resolution." 3. "Section 2-48. Order of business. The order of business at Council meetings will be as established separate resolution of the Council." SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of f if teen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within f if teen (15 ) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
