HomeMy WebLinkAbout89-11 Include Provisions for Establishing Fees for Planning Services By City Council ResolutionORDINANCE NO. 89-11 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING TITLES 5 AND 13 OF THE COSTA MESA MUNICIPAL CODE TO INCLUDE PROVISIONS FOR ESTABLISHING FEES FOR PLANNING SERVICES BY CITY COUNCIL RESOLUTION. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council finds and declares that: 1. Titles 5 and 13 of the Municipal Code presently specify certain fees for various planning services; these fees are not required by State law to be codified and can be set by City Council resolution, thereby simplifying the process of updating fees to reflect current costs. ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends Titles 5 and 13 of the Municipal Code as set forth below. SECTION 2. 1. Amend Section 5-120(D) 1. as follows; delete Section 5-120(D) 2., 3., and 4.; (1) Fees for Sign Permits, Planned Signing Programs, amendments to an adopted Planned Signing Program, Sign Variances, and Minor Sign Variances shall be established by resolution of the City Council. 2. Amend Section 13-200 to include the following subsection: 7. Fees: An application for a master plan shall be accompanied by all applicable processing fees as established by resolu- tion of the City Council. 3. Amend Section 13-253 2. to read as follows: 2. Application: The review of a planned development applica- tion shall be processed as a Conditional Use Permit in accordance with the provisions of Article 23 of this chapter (Sections 13-341 through 13-352). Appropriate fees, as established by resolution of the City Council, shall accom- pany the application. 4. Amend Section 13-277 6. to read as follows: 6. Fees. Fees for preliminary plans, final development plans, and amendments to an approved plan shall be established by resolution of the City Council. 5. Amend Section 13-307 to include the following: 4. An application for a master plan shall be accompanied by all applicable processing fees as established by resolution of the City Council. 6. Amend Section 13-351 (c) to read as follows: (c) Application for an Administrative Adjustment or Minor Condi- tional Use Permit shall be made to the Zoning Administrator on forms provided. Plans and information reasonably needed to analyze the application may be required by the Zoning Administrator. The application shall be accompanied by all applicable processing fees as established by resolution of the City Council. 7. Amend Section 13-366 1. to read as follows: 1. A filing fee, as established by resolution of the City Coun- cil, shall accompany the application. 8. Amend Section 13-468 to read as follows: Section 13-468. Fees; Time Limitation on Approval. (a) An,application for a tentative parcel map shall be accom- panied by all applicable processing fees as established by resolution of the City Council. (b) The approval of a tentative parcel map as set forth in this article shall be for the period of twenty-four (24) months; provided, however, that the applicant for approval may apply to the Planning Commission for an extension of time for a period or periods not exceeding a total of three (3) years. 9. Amend Section 13-442 to read as follows: An application for a tentative map shall be accompanied by all applicable processing fees as established by resolution of the City Council. - 2 - 10. Add Section 13-647 to read as follows: Section 13-647. Processing Fees. Any application for a proposed development plan submitted for review by the Redevelopment Agency pursuant to Section 7.7 of the Redevelopment Plan for the Costa Mesa Downtown Redevelopment Project shall be accompanied by all applicable processing fees as established by resolution of the City Council. 11. Amend Section 13-826 (a) to read as follows: (a) Processing fee. Each application shall be accompanied by a processing fee as established by resolution of the City Council. SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or,. in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
