HomeMy WebLinkAbout89-15 Rezoning of Property Bordered by 19th Street, Harbor Blvd, and Newport Blvd, from C2 to PDCORDINANCE NO. 89-15 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CHANGING THE ZONING OF PROPERTY BORDERED BY 19TH STREET, HARBOR BOULE- VARD, AND NEWPORT BOULEVARD FROM C2 TO PDC. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. There is hereby placed and included in the PDC zone all that real property bordered by 19th Street, Harbor Boulevard, and Newport Boulevard, 1988-89 Assessor Parcel Numbers 424-231-01, 05, 06, 07, 08, 09, 10, 11, 12, 13, 14, 15, 16, 17, 19, 21, 22, and 23, situated in the City of Costa Mesa, County of Orange, State of California, to wit: Those portions of lots 1 through 17, inclusive, Lot 20 and a portion of Lot 18, Block "A", Tract No. 18, in the City of Costa Mesa, County of Orange, State of California, together with a portion of Newport Avenue as shown on the map filed in Book 9, Page 20 of Miscellaneous Maps and those portions of Lots 1 through 5, inclusive, of Tract No. 424, as shown on the map filed in Book 17, page 23 of Miscellaneous Maps, both of the records of said County, described as a whole as follows: Gcmmencing at the center line intersection of Nineteenth Street and Harbor Boulevard (Fairview Avenue per said tracts); thence along the centerline of said Harbor Boulevard, SO°22'12"W, 108.40 feet; thence leaving said centerline S89037148"E, 45.00 feet to the true point of beginning; thence continuing S89037148"E, 5.00 feet to the beginning of a non -tangent curve concave southeasterly; thence northerly, north- easterly and easterly along said curve having a radius of 28.00 feet, a radial line to said beginning bears N89037148"W, through a central angle of 92131'11", an arc distance of 45.21 feet to the beginning of a reverse curve concave northerly; thence easterly along said curve having a radius of 1553 feet, a radial line to said beginning bears S2053123"W, through a central angle of 2032148", an arc distance of 69.03 feet to a point that is 82.00 feet southerly, measured at right. angles, frau the centerline of said Nineteenth Street; thence parallel with said centerline S89039125"E, 324.44 feet to the beginning of a tangent curve concave southerly; thence easterly along said curve having a radius of 28.00 feet, through a central angle of 16018146", an arc distance of 7.97 feet; thence S73120139"E, 35.21 feet -to the beginning of a tangent curve concave northerly; thence easterly along said curve having a radius of 42.00 feet, through a central angle of 10030148", an arc distance of 7.71 feet to the beginning of a reverse C curve concave southerly; thence easterly along said curve having a radius of 487.00 feet, a radial line to said beginning bears N6008133"E, through a central angle of 4042102", an arc distance of 39.95 feet to the beginning of a compound curve concave westerly; thence easterly, southeasterly, southerly and southwesterly along said curve having a radius of 28.00 feet, a radial line to said beginning bears N10°50"35"E, through a central angle of 119°48'08", an arc distance of 58.55 feet to a point that is 88.00 feet northwesterly, measured at right angles, frau the centerline of Newport Boulevard (Newport Avenue per said Tract No. 18), said centerline being also noted as the "southeast line of Lot B of the Banning Tract" on said Tract No. 18; thence parallel with said centerline, S40038143W", 707.17 feet to the southeastly prolongation of the southwesterly line of the northeasterly 25.00 feet of Lot 16, Block "A" of said Tract No. 18; thence along said south- easterly prolongation and said southwesterly line, N49°21'25"W, 99.02 feet to the easterly line of Harbor Boulevard, having a 45.00 foot half -width, as described in the document recorded in Book 1821, page 280 of official records; thence along said easterly line, NO122112"E, 290.75 feet to the southerly line of Lot 6 of said Tract No. 428; thence along said southerly line S8913913911E, 5.00 feet to the easter- ly line of said Harbor Boulevard, having a 50.00 foot half -width, as described in the document recorded in Book 8523, page 824 of official records; thence along said easterly line, N002212"E1, 50.05 feet to the northerly line of said Lot 6; thence along said northerly line, N89039135"W, 5.00 feet to the easterly line of Harbor Boulevard, having a 45.00 foot half -width, as described in the document recorded in Book 1821, page 280 of official records; thence along said easterly line N0022112"E, 171.84 feet to the point of beginning. SECTION 2. Pursuant to the provisions of Section 13-79 of the Costa Mesa Municipal Code, District Map B-2 of the City of Costa Mesa, a copy of which is on file in the office of the Planning Division, is hereby amended by the addition thereto of the PDC area described in Section 1 hereof. SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of f if teen (15) days from its passage shall be published once in the ORAANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of -2- this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned sum -nary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against same.
