HomeMy WebLinkAbout89-20 Amending Section 2-189 Concerning Settlement of Certain ClaimsORDINANCE NO. 89-20 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING COSTA MESA MUNICIPAL CODE SECTION 2-189 CONCERNING SETTLE- MENT OF CERTAIN CLAIMS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa hereby finds and declares as follows: 1. The Costa Mesa Municipal Code currently provides that a claims administrator under contract with the City may be authorized to allow, compromise, or settle any tort claim for a sum no greater than one thousand dollars ($1,000.00). 2. The City is currently engaged in the process of hiring a risk manager as an employee of the City. The duties of the risk manager will include processing and adjustment of small claims, so that this function will no longer need to be done by a claims administrator acting as an inde- pendent contractor. 3. .In order to facilitate the adjustment of small claims by the risk manager, it is appropriate to authorize the risk manager, with the approval of the City Attorney, to allow, compromise, or settle any claim for a sum not to exceed one thousand dollars ($1,000.00). lows: ACCORDINGLY, the Costa Mesa Municipal Code is hereby amended as fol- SECTION 2. Costa Mesa Municipal Code, Title 2, Chapter V, Article III, Section 2-189(b), is hereby amended to read as follows: "(b) The risk manager is hereby authorized, with the concurrence of the City Attorney, to allow, compromise, or settle any tort claim for a sum no greater than one thousand dollars ($1,000.00)." The foregoing amendment shall not alter, diminish, or terminate the existing authority of the claims administrator under contract with the City at the time this ordinance becomes effective, until the current contract expires or is otherwise terminated. SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the off ice of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
