HomeMy WebLinkAbout89-30 Amendment Relating to Permit ParkingORDINANCE NO. 89- 36 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING CHAPTER XI OF TITLE 10 OF THE COSTA MESA MUNICIPAL CODE RELATING TO PERMIT PARKING THE CITY COUNCIL OF THE 'CITY 'OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Costa Mesa does hereby find and declare as follows: WHEREAS, a number of persons who are not employed by the City are encroaching upon employee parking areas of City -owned facilities; and WHEREAS, Regulation XV (Trip Reduction Plan) of the Southern California Air Quality Management District requires that the City of Costa Mesa, as an employer, achieve a 1.5 Average Vehicle Ridership by July, 1990; and WHEREAS, the implementation of Regulation XV necessitates reliable documentation procedures,and segregated parking on City - owned facilities would be instrumental to the acquisition of accurate data by excluding vehicles not operated by City employees; and WHEREAS, providing adequate parking .for City employees adjacent to their work assignment is beneficial to the health, welfare, safety and convenience of City employees; ACCORDINGLY, the City Council of the City of Costa Mesa does hereby amend the Costa Mesa Municipal Code as follows: Section 2. The Costa Mesa Municipal Code, Title 10, Chapter XI, Article 3 is amended to read as follows: "Section 10-222. Designation of 'Permit Parking only, Areas. The City Manager may designate portions of city -owned property other than streets, alleys, or highways, for parking by permit only and may order the posting of signs bearing the legend, "Permit Parking Only." Section 10-223. Prohibited Parking. (a) When authorized signs have been posted and are in place giving notice of restrictions as provided herein, it shall be unlawful and an infraction for any person to park or leave parked a vehicle, other than a City -owned vehicle, within the area designated for parking by permit only, between the hours of 5:00 a.m. and 5:00 p.m. on weekdays, unless a parking permit therefor, issued by the City of Costa Mesa, is displayed in or on the vehicle so as to be visible from outside the vehicle. (b) When a portion of City -owned property has been designated and posted for parking by permit only, it shall be unlawful and an infraction to park or leave parked a vehicle belonging to a City officer or employee outside the designated area between the hours of 5:00 a.m. and 5:00 p.m. on weekdays. "Belonging to" as used herein shall include "owned by," "leased to "rented toy" "borrowed byy" and "operated by." Section 10-224. Enforcement. Any regularly employed and salaried police officer or police cadet, or any non -safety City employee empowered to issue citations pursuant to Section 1-33.1 of this Code and implementing resolutions of the City Council, is authorized to enforce the provisions of this Article by issuing infraction citations. This Ordinance shall take effect and be in full force and effect thirty (30) days from and after its passage and, before the expiration of fifteen (15) days after its passage, shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation printed and published in the City of Costa Mesa, or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the. text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the,names of the members of the City Council voting for and against the same.
