HomeMy WebLinkAbout90-06 Reserve Police OfficersORDINANCE NO. 90-6 AN ORDINANCE OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING CHAPTER III OF TITLE 14 OF THE COSTA MESA MUNICIPAL CODE PERTAINING TO RESERVE POLICE OFFICERS THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: Section 1: The City Council of the City of Costa Mesa, California, does hereby find and declare as follows: WHEREAS, the Costa Mesa Police Department desires to elevate certain Costa Mesa Level I reserve police officers to full peace officer status; and WHEREAS, the Costa Mesa Municipal Code in its present form provides for full peace officer status designation to those reserve officers who were issued Level I certificates prior to January 1, 1981, but does not provide for full peace officer status for those reserve officers who completed the necessary training after that date; and WHEREAS, an amendment to Title 14 of the Costa mesa Municipal Code will correct such omission; and WHEREAS, an amendment to this ordinance is necessary to promote the health, safety and welfare of the citizens of the City of Costa Mesa. ACCORDINGLY, the City Council of the City of Costa Mesa herewith amends Title 14, Chapter III, Section 14-50.1(a) of the Costa Mesa Municipal Code: Section 2: Title 14, Chapter III, Section 14-50(a) of the Costa Mesa Municipal Code is hereby amended as follows: Sec. 14-50.1 Level I reserve officers qualified to perform general law enforcement duties. "(a) All reserve police officers who are issued a peace officer's stands and training level I reserve officer certificate before January 1, 1981, or reserve officers appointed pursuant to Penal Code Section 830.6(a)(2) and who have completed the Basic Course prescribed by the'Commission on Peace Officer Standards and Training (POST) for regular peace officers, may be designated to possess the full powers of a peace officer as provided by Penal Code Section 830.1, by the City Manager on recommendation of the Chief of Police, who has determined such reserve officer qualified to perform general law enforcement duties by reason of the reserve officer's training and experience." Section 3. Publication This Ordinance shall take effect and be in full force and effect thirty (30) days from and after its passage and, before the expiration of fifteen (15) days after its passage, shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation printed and published in the City of Costa Mesa, or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
