HomeMy WebLinkAbout97-13 Rezoning of 120 Virginia Place and 2060 Newport BlvdORDINANCE NO. 97-13 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING REZONE PETITION R-97-01, CHANGING THE ZONING OF 120 VIRGINIA PLACE AND 2060 NEWPORT BOULEVARD IN THE NEWPORT BOULEVARD SPECIFIC PLAN AREA. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS. SECTION 1 The City Council of the City of Costa Mesa finds and declares as follows: WHEREAS, the Newport Boulevard Specific Plan was adopted by City Council Resolution No. 96-69 in July, 1996; and WHEREAS, included in the Specific Plan was an implementation program which recommended rezoning certain commercially zoned properties to a residential zoning district; and WHEREAS, the existing C2 zoning of 120 Virginia Place is not consistent with the 1990 General Plan designation of Commercial -Residential; and WHEREAS, the proposed rezones are consistent with the 1990 General Plan designation of Commercial -Residential; and WHEREAS, the mitigated Negative Declaration prepared for Newport Boulevard Specific Plan SP -96-01 and General Plan Amendment GP -96-01 B previously adopted by the City Council on July 15, 1996, has been determined to be adequate for the proposed amendments to the City of Costa Mesa Official Zoning Map. ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends the City of Costa Mesa Official Zoning Map as follows: SECTION 2. There is hereby placed and included in the R2 -HD zoning district all that real property shown on attached Exhibit A and described in Exhibit B, situated in the City of Costa Mesa, County of Orange, State of California. SECTION 3. There is hereby placed and included in the C1 zoning district all that real property shown on attached Exhibit C and described in Exhibit D, situated in the City of Costa Mesa, County of Orange, State of California. SECTION 4 Pursuant to the provisions of Section 13-79 of the Costa Mesa Municipal Code, District Maps G-3 and G-4 of the City of Costa Mesa are hereby amended by the change of zoning described in Sections 2 and 3 hereof and in the respective exhibits. Copies of the District Maps are on file in the office of the Planning Division. SECTION 5. If any provision or clause of this ordinance or the application thereof to any person or circumstances is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect other provisions or clauses or applications of this ordinance which can be implemented without the invalid provision, clause, or application; and to this end, the provisions of this ordinance are declared to be severable. SECTION 6. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen It 5) days from its passage shall be published once in a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
