HomeMy WebLinkAbout97-14 Adoption of Rezone Petition R-97-03; Prezoning Santa Ana Country Club and other Areas on Bristol StreetORDINANCE NO 97-14 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, PREZONING THE SANTA ANA COUNTRY CLUB AND SEVERAL COMMERCIAL COUNTY AREAS ON BRISTOL STREET BY ADOPTION OF REZONE PETITION R-97-03. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS. SECTION 1 The City Council of the City of Costa Mesa finds and declares as follows: WHEREAS, the City Council desires to annex the Santa Ana Country Club and several commercial areas on Bristol Street and Santa Ana Avenue from the County of Orange; and WHEREAS, as part of the annexation process, the Local Agency Formation Commission may require the prezoning of property prior to approving an annexation request; and WHEREAS, in anticipation of annexation approval, and in an effort to expedite the process, the City Council desires to prezone the area; and WHEREAS, the proposed prezone is consistent with the 1990 General Plan designation for property located within the City's official Sphere of Influence; and WHEREAS, when the annexation is approved, the proposed amendments to the City of Costa Mesa Official Zoning Map shall be completed; and WHEREAS, the prezoning is exempt from the requirements of the California Environmental Quality Act pursuant to Section 15061(b); ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends the City of Costa Mesa Official Zoning Map as follows: SECTION 2. Place Institutional and Recreational zoning on the Santa Ana Country Club (Subarea 1 A), C1 zoning on Subarea 1 B, and C2 zoning on Subarea 1 C, as shown on attached Exhibit A and described on attached Exhibit B, situated in the City of Costa Mesa, County of Orange, State of California. SECTION 3. Pursuant to the provisions of Section 13-79 of the Costa Mesa Municipal Code, District Map G-7 of the City of Costa Mesa are hereby amended by the change of zoning described in Section 2 and in the respective exhibits. Copies of the District Maps are on file in the office of the Planning Division. SECTION 4 If any provision or clause of this ordinance or the application thereof to any person or circumstances is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect other provisions or clauses or applications of this ordinance which can be implemented without the invalid provision, clause, or application; and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
