AN ORDINANCE OF THE CITY COUNCIL OF THE, CITY OF
COSTA MESA, CALIFORNIA, ESTABLISHING TRANSPORTATION
DEMAND MANAGEMENT (TDM) REQUIREMENTS FOR SPECIFIED
NEW DEVELOPMENT PROJECTS
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1: FINDINGS AND PURPOSE
The City Council of the City of Costa Mesa hereby finds and determines that:
WHEREAS, state law establishing requirements for development of a countywide Congestion
Management Program (AB 1791) mandates the inclusion of a Trip Reduction and Travel Demand
Element/ Ordinance: and
WHEREAS, other Transportation Demand Management (TDM) program requirements have been
adopted for the region including Regulation XV and Appendix IV -G Control Measures of the Air
Quality Management Plan (AQMP); and
WHEREAS, generally, increased traffic congestion contributes to significant deterioration in air
quality; increases the inefficient use of energy resources; and adversely impacts public and private
sector economics due to reduced productivity of the work force; and
WHEREAS, various efforts underway including the Congestion Management Program (CMP)
recognize and encourage the use of Transportation Demand Management (TDM) strategies to
increase mobility and improve the general efficiency of the transportation system by enhancing vehicle
flow and shifting demand on existing transportation facilities; and
WHEREAS, implementation of TDM strategies at the local government level would provide significant
public benefits by improving air quality; enhancing the effectiveness of the existing transportation
system; and reducing energy requirements; and
WHEREAS, coordinated TDM efforts among all local jurisdictions in the County can contribute to
air quality improvements, energy conservation, and decreases in the levels of noise and traffic
congestion;
ACCORDINGLY, the City Council of the City of Costa Mesa herewith adds Article 5 to Chapter XIII,
Title 13, of the Costa Mesa Municipal Code, establishing transportation demand management
requirements for specified new development projects.
SECTION 2• ARTICLE 5
Article 5 is hereby added to Chapter XIII, Title 13, of the Costa Mesa Municipal Code to read as follows:
ARTICLE 5. TRANSPORTATION DEMAND MANAGEMENT REQUIREMENTS
FOR SPECIFIED NEW DEVELOPMENT PROJECTS
SECTION 13-880: INTENT
This Article is intended to meet the requirements of Section 65089 (b) (3) of the California Government Code
which requires development of a trip reduction and travel demand element to the Congestion Management
Program, and Section 65089.3 (b) which requires adoption and implementation of Trip Reduction and Travel
Demand Ordinance.
SECTION 13-881: POLICY
New commercial, industrial, and mixed-use development including employment centers of 100 persons or more
may adversely impact existing transportation and parking facilities, resulting in increased motor vehicle
emissions, deteriorating levels of service, and possibly significant additional capital expenditures to augment
and improve the existing transportation system. In order to more efficiently utilize the existing and planned
transportation system and to reduce vehicle emissions, it is the policy of the City of Costa Mesa to:
a) Reduce the number of peak -period vehicle trips generated in association with additional development.
b) Promote and encourage the use of alternative transportation modes such as ridesharing, carpools,
vanpools, public bus and rail transit, bicycles and walking, as well as those facilities that support such
modes.
c) Achieve related reductions in vehicle trips, traffic .congestion, and public expenditure and achieve air
quality improvements through utilization of existing local mechanisms and procedures for project
review and permit processing.
d) Promote coordinated implementation of strategies on a countywide and citywide basis to reduce
transportation demand.
e) Achieve the most efficient use of local resources through coordinated and consistent regional and/or
local TDM programs.
SECTION 13-882: DEFINITIONS
For purposes of this Article, the definitions for the following terms shall apply:
Alternative Transportation Modes: Any mode of travel that serves as an alternative to the single
occupant vehicle, during peak hours of traffic operations (i.e., 6-10 AM and 4-6 PM). This can
include all forms of .ridesharing such as carpooling or vanpooling, as well as public transit, bicycling
or walking.
Applicable Development: Any new development project that is determined to meet or exceed the
employment threshold using the criteria contained in Section 13-883.
Developer: The builder who is responsible for the planning, design and construction of an applicable
development project. A developer may be responsible for implementing the provisions of this
Ordinance as determined by the property owner.
Employee: Any person employed by a firm, person(s), business, educational institution, non-profit
agency or corporation, government agency or, other entity which employs 100 or more persons at a
single worksite.
Employment Generation Factors: Refers to factors developed for use by the jurisdiction for projecting
the potential employment of any proposed development project. (Note: The factors presented in this
Article have been developed and are used by the County of Orange for various socioeconomic data
and transportation modeling efforts.)
Employer: Any person(s), firm, business, educational institution, government agency, non-profit agency
or corporation, or other entity which employs 100 or more persons at a single worksite, and may
either be a property owner or tenant of an applicable development project.
Facility(s): The total of all buildings,, structures and grounds that encompass a worksite, at either
single or multiple locations, that comprises or is associated with an applicable development project.
Mixed -Use Development: New development projects that. combine any one of these land uses with
another: office, commercial, light industrial, and business park.
New Development Project: Any non-residential project being processed where some level of
discretionary action by a decision-making body is required.
Transportation Demand Management (TDM): Development and implementation of programs, plans,
reports or policies designed to encourage changes in individual travel behavior. TDM can include an
emphasis on alternative travel modes to the single occupant vehicle (SOV) such as carpools, vanpools
and transit; reduction or elimination of the number of vehicle trips, or shifts in the time of vehicle
commutes to .other than the peak -periods.
SECTION 13-883: APPLICABILITY
A. This Article shall apply to all, new development projects that are estimated to employ a total of 100
or more persons as determined by the methodology contained in Section B, below.
B. For purposes of determining whether a new development project is subject to this Article, the total
employment figure will be determined as follows:
1. Employment projectionsdeveloped by the project applicant, subject to approval by the City
Development Services Director.
2. Employment projections developed by the City of Costa Mesa using the following employee
generation factors by type of use.

The employment projection for a development of mixed or multiple uses shall be calculated based
upon the proportion of development devoted to each type of use.
SECTION 13-884: FACILITY STANDARDS
All applicable developments shall be subject to the Facility Standards as specified in this Section and shall
provide one or more of the improvements identified below:
1- Preferential Parking for Carpool Vehicles
a) At least 15% of the employee parking spaces shall be reserved and designated for carpool
vehicles by marking such spaces "Carpool Only".
b) Carpool spaces shall be used only by carpool vehicles in which at least two of the persons will
be employees or tenants of the proposed project, or where a Reciprocal Preferential Carpool
Parking Agreement with other developments has been established.
c) Such carpool spaces shall be located near the building's employee entrance(s) or at other
preferential locations within the employee parking areas as approved by the City of Costa
Mesa.
(The intent of this Section is not to preclude parking arrangements for visitors and
handicapped, but to provide preferential carpool parking within the general employee parking
areas. The factors listed_ below shall be used to determine the number of employee parking
spaces.)
d) The total number of employee parking spaces shall be determined by using the following
factors by type of use as specified in Chapter V of this Title.

2- Bicycle Parking and Shower Facilities
Bicycle parking and locker facilities shall be provided in a secure location for use by employees or
tenants who commute to the site by bicycle or walking in accordance with, the following standards:
a) The number of bicycle facilities/racks shall be provided at the rate of at least one rack for
every 50 employees or fraction thereof. The maximum number of bicycle parking spaces
required for less than 1,000 employees shall be 20 spaces and 30, spaces for 1,000 or more
employees. All required bicycle parking facilities shall in be in secured location(s) as
approved by the Transportation Services Manager.
b) Shower and locker facilities shall only be required in new buildings of 100,000 sq. ft. or more.
A minimum of 2 showers and 4 lockers shall be provided for each sex.
3- Information on Transportation Alternatives
a) A commuter information area shall be provided that offers employees appropriate
information on available transportation alternatives to the single -occupancy vehicle. This
area shall be centrally located and accessible to all. employees or tenants.
b) Information in the area shall include, but not be limited to, the following:
1) Current maps, routes and schedules for public transit.
2) Ridesharing match lists.
3) Available employee incentives.
4) Ridesharing promotional material supplied by commuter -oriented organizations.
4- Rideshare Vehicle Loading Areas
a) The need for, design, and location of passenger loading areas for passengers to embark and
disembark from rideshare vehicles shall be reviewed by the City of Costa Mesa.
b) Passenger loading areas shall be of a size large enough to accommodate the number of
waiting vehicles equivalent to the rate of at least five spaces per every 100 of the required
parking spaces for the project.
c) The passenger loading areas shall be located as close as possible to the building's employee
entrance(s), and should be designed in a manner that does not impede vehicular circulation
in the parking area. .
5- Vanpool Vehicle Accessibility
a) The need for, design, and location of passenger loading areas for passengers to embark and
disembark from vanpool vehicles shall be reviewed by the City Transportation Services
Manager.
b) The design of all parking facilities shall incorporate provisions for access and parking of
vanpool vehicles..
c) Where applicable, vanpool vehicle accessibility shall include a minimum of 77 vertical
clearance for those parking spaces and ramps to be used by such vehicles.
d) Vanpool parking spaces shall be located near the building's employee entrance(s) or other
preferential locations as approved by the City of Costa Mesa.
e) The number of accessible vanpool parking spaces shall be at the rate of at least 5% of the
total required employee car pool parking spaces as determined in Section 13-884(1)(d).
6- Bus Stop Improvements
a) The need for, design, and location of potential improvements at area bus stops shall be
reviewed by the City of Costa Mesa.
b) Bus shelters, pullouts, and pads, shall be provided as necessary in consultation with and with
approval by the affected transit service providers.
SECTION 13-885: PARKING INCENTIVES
The total number of employee. parking spaces as defined in Section 13-884 may be reduced by the following
factors:
a) Additional carpool/vanpool parking - One and one half (1 1/2) employee parking space may be
eliminated for each additional carpool or vanpool space provided in excess of the number required
by Section 13-884. However, such .reduction shall not exceed three (3) percent of the total employee
parking spaces.
b) Additional bicycle parking and shower/locker facilities - New development projects may reduce the
required number of employee parking spaces for additional bicycle parking and shower/locker facilities
provided in excess of that required by Section 13-884. However, such reduction shall not exceed three
(3) percent of the total employee parking spaces.
SECTION 13-886: IMPLEMENTATION AND MONITORING
For the purpose of determining whether applicable developments are in compliance with the provisions of this
Article, City of Costa Mesa shall monitor such compliance in a manner it deems appropriate and reasonable.
Monitoring mechanisms to verify compliance with the Facility Standards required under Section 13-884 may
include, but not be limited to, the following:
1. Current City of Costa Mesa procedures for site development plan review as appropriate.
2. Field/Site Inspections.
3. Other building site reports/surveys which the City may deem appropriate.
SECTION 13-887: ENFORCEMENT AND PENALTIES
For purposes of ensuring that applicable developments comply with the provisions of this Article, City of
Costa Mesa shall, following written notice to subject property owner or designee (employer), initiate
enforcement actions(s) to enforce compliance with the Facility Standards under Section 13-884, which may
include, but not be limited to, the following:
1. Withholding issuance of a Building Permit or Certificate of Use and Occupancy:
2. Issuance of Stop Work Order(s).
3. Enforcement as provided in Sec. 13-18.
SECTION 13-888: APPEALS
Decisions of the Development Services Director or the Public Services Director may be appealed pursuant to
Section 2-300 et seq. of the Costa Mesa Municipal Code.
SECTION 3: PUBLICATION
This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and
prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST
DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in
the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy
of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of
adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be
published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this
Ordinance together with the names of the members of the City Council voting for and against the same.
