HomeMy WebLinkAbout92-17 Rezoning of Properties Located in General Plan Planning AreaORDINANCE NO. 92-17 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CHANGING THE ZONING OF PROPERTIES LOCATED IN GENERAL PLAN PLANNING AREA NUMBERS FIVE AND SIX TO ZONING CONSISTENT WITH THE 1990 GENERAL PLAN, BY ADOPTION OF REZONE PETITION R-92-03. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS. FOLLOWS: " SECTION 1.: The City Council of the City of Costa Mesa finds and declares as follows: WHEREAS, the City of Costa Mesa 1990'General Plan was adopted by City Council Resolution #92-27 on March 16, 1992; and WHEREAS, adoption of the 1990 General Plan included amendments to the General Plan Land Use Map which affected many properties in the six (6) Planning Areas of the City as well as revisions to the definitions of the residential, commercial, industrial and institutional land use designations; and WHEREAS, inconsistencies did result between.the 1990 General Plan and the current zoning of various properties in the City; and WHEREAS, pursuant to California Government Code Section 65860 (c), inconsistent zoning ordinances and maps shall be amended within a reasonable time to be consistent with the General Plan as amended; and WHEREAS, Final Environmental Impact Report #1044. (SCH# 88122116) prepared for the City of Costa Mesa 1990 General Plan, previously certified by the City Council on March 16, 1992, has been determined to be adequate for the proposed amendments to the City of Costa Mesa Official Zoning Map, pursuant to Section 15168 (c)(2) of the California Environmental Quality Act guidelines; .ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends the City of Costa Mesa Official Zoning Map as follows: SECTION 2.: There is hereby placed and included in the R2 zone all that real property shown on attached Exhibit "A" and described in attached Exhibit "B", situated in the City of Costa Mesa, County of Orange, State of California. SECTION 3.: There is hereby placed and included in the R3 zone all that real property shown on attached Exhibit "C" and described in attached -Exhibit "D", situated in the City of Costa Mesa, County of Orange, State of California. SECTION 4.: There is hereby placed and included in the C1 zone all that real property shown on attached Exhibit "E" and described in attached Exhibit "F", situated in the City of Costa Mesa, County -of Orange, State of California. SECTION 5.: There is hereby placed and included in the C2 zone all that real property shown on attached Exhibit "G" and described in attached Exhibit "H", situated in the City of Costa Mesa, County of Orange, State of California. SECTION 6.: There is hereby placed and included in the PDI zone all that real property shown on attached Exhibit "I" and described in Exhibit "J", situated in the City of Costa Mesa, County.of Orange, State of California. SECTION 7.: There is hereby placed and included in the I&R zone all that real property shown on attached Exhibit "K" and described in -attached Exhibit "L", situated in the City of Costa Mesa, County of Orange, State of California. SECTION 8.: Pursuant to the provisions of Section 13-79 of the Costa Mesa Municipal Code, District Maps C-9, E-7, E-8, and E-9, of the City of Costa Mesa are hereby amended by the change of zone described in Sections 1 through 7 hereof and in the respective Exhibits. Copies of the District Maps are on file in the office of the Planning Division. SECTION 9.: This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15 ) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the. City Clerk a certified copy of this Ordinance together with the names and members of the City Council voting for and against the same.. PASSED AND ADOPTED this 5'P6 day of A&V19Qa.
