HomeMy WebLinkAbout94-04 Amending Sections of Code Relating to Existing FeesORDINANCE NO. 94-.4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING SECTIONS 9-122, 9-129, 9-168, 9-186, 9-188, 9-235(d), 9-252, 9-255, 9-274, 11-160, 11-172, 13- 743(1),, 15-65 AND 2-450 OF THE COSTA MESA MUNICIPAL CODE RELATING TO EXISTING FEES. THE CITY COUNCIL OF -THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 9-122 of the Costa Mesa Municipal Code is hereby amended to read as follows: "Sec. 9-122. Permit Fees. Unless otherwise stated in this Title, the fee for filing an applicationfora permit 'pursuant to this Chapter shall 'be payable in advance and set by resolution of City Council. Permit fee is nonrefundable except.when paid in duplicate or erroneously _collected,. and is in addition to any business tax which may be required of the permittee." Section 2. Section 9-129 of the Costa Mesa Municipal Code is hereby amended to read as follows: "Sec. 9-129. Businesses Where,Fire Chief May Issue Permits. All businesses that -require a permit from the Fire Chief, as provided in.Title.7 of this Code, shall pay a permit fee as set by resolution -of City Council." Section 3. Section 9-168 of the Costa Mesa Municipal Code is hereby amended to read as follows: "Sec. 9-168. Duration of Permit; deposit. Prior to the granting of.the permit, the applicant shall post with the Director of Finance of the City of Costa Mesa, a cash deposit in a sum set by resolution of City Council which shall be forfeited to the City in the event that the permittee does not thoroughly clean the premises and remove all trees, rubbish and debris therefrom on or before January 2nd following the issuance of the permit. If such premises are thoroughly cleaned, all trees, rubbish and debris so removed, as aforesaid, the said cash deposit shall be returned to the permittee." Section 4. Section 9-186 of the Costa Mesa Municipal Code is hereby amended to read as follows: "Sec. 9-186 Permit Fee. The fee for the issuance of.the permit required by this Chapter shall be set by resolution of City Council." Section 5. Section 9-188 of the Costa Mesa Municipal Code is hereby amended to read as follows: "Sec. 9-188. Bond to Ensure Removal. Prior to the erection of any temporary stand for the display and sale of fireworks, the permittee shall post with the city a cash deposit in a sum set by resolution of City Council to be forfeited to the City in the event the permittee does not remove said stand, equipment and rubbish from the premises upon which the stand is located E before midnight of July 7, of. the year for which .said permit is granted. -The Fire Department shall make an inspection and, if all equipment, rubbish and debris are. removed by the permittee as aforesaid, it shall notify the Director.of Finance -and the cash bond shall thereupon be returned to the permittee." Section 6. Subsection (d) of Section 9-235 of, the Costa Mesa Municipal Code is hereby amended to read as follows:. "(d) -Fee: For filing such application the applicant shall pay a fee set by resolution of City Council." Section 7. The, first paragraph of Section 2-252'of the Costa Mesa Municipal Code -is hereby amended .to'read as follows: "Sec. 9-252. Driver's -Permit -Requirements. No person shall drive or operate a. taxicab in the City without first obtaining a"permit in writing to.do so -.from the. Chief of.Police. Any person desiring to -obtain such driver's permit shall make a written application therefor to the Chief of Police accompanied by a fee set by resolution of City.Council. No permit shall be issued to -any person under the age of eighteen (18) years, or to any person who. -has been convicted of a felony or to any person who, within a period of two (2) years immediately preceding such application, has been 'convicted. of reckless driving or., driving a vehicle upon a highway while, -under the influence of .intoxicating liquors. or drugs, or convicted of any .of, the provisions of the 3 alcoholic. beverage : control act of the State 'of California,. or to ,any person who is for any reason whatsoever unable or incompetent to safely handle such. automobile.- Any falsification on'the application for said permit will be grounds for the -refusal of the said permit." Section 8.. Section 9-255 of the Costa Mesa Municipal Code is hereby amended to read as follows: "Sec. 9-255.. Filing Fee. An application as required by this -Chapter shall be accompanied by a filing fee :set by resolution of City Council for each taxicab which applicant proposes to operate within the City to cover the administrative cost to the City of processing the application." Section 9. Section 9-274 of the Costa Mesa Municipal Code. is hereby amended.to read as follows: "Seca 9-274. Towing Service Certificate Application Filing.Fee. An application as required by Section 9-273 shall be accompanied by a filing fee set by resolution of City Council for each tow unit which applicant proposes .to operate within the City.to cover -the administrative cost to the City for processing the application." Section 10. Section 11-160 of the Costa Mesa Municipal Code is hereby amended to read as follows: 4 "Sec. 11-160. .False Alarm Service Charge. A service charge shall be paid to the City of Costa Mesa by alarm users for each false alarm upon the third response and for each subsequent police response or second response for each subsequent fire response to the location of the alarm system during a twelve-month period in accordance with the fee schedule set by resolution of City Council. New alarm systems shall be exempt during the first thirty (30) days of operation." Section 11. Subsections (a) and (b) of Section 11-172 of the Costa Mesa Municipal Code is hereby amended to read as follows: (a) The police services fee shall include the cost of personnel and.equipment but shall not exceed a fee set by resolution of City Council. (b) The City does not hereby waive its right to seek reimbursement for actual costs exceeding five hundred dollars ($500.00) and such fee will be set by resolution of City Council." Section 12. Subsection (1) of Section 13-743 of the Costa Mesa Municipal Code is hereby amended to read as follows: 11(1) A single permit fee set by resolution of City Council shall be paid for each home occupation permit applied for. Thereafter, fees due, if any, shall be under the business license provisions of this Code." 5 "Seca 15-65. Drainage Fees Established.. There is hereby established a drainage fee set by resolution of City Council being developed as set forth. in this chapter on a. prorated basis. The funds collected hereunder shall be deposited in a separate fund which shall be known as the "Drainage Fee Fund." Said fee shall be collected, deposited and expended in the case of subdivisions and parcel maps in accordance with Section 11543.5 of the Business and Professions Code, State of California, and all other applicable laws of the State. All fees collected {in cases 'other than the case of subdivisions and parcels subject to parcel maps shall be paid in and deposited in accordance with rules. and regulations,as set forth by the Director of Finance for the City." Section 14. Subsections (6) through (27) are added'to Section 2-450 of the Costa Mesa Municipal Code to read as follows: (6) Development Agreement Annual Review (7) Continued Public Hearing (8) Zoning Administrator Time Extension (9) Planning Action Time Extension (10) Conditional Use Permit,-Renewal (11) Zoning Administrator Appeal' .(12) Rehearing, City Council (13) Research Fee (14) Street Banner Permit C (13) Research Fee (14) Street Banner Permit (15) Street Closure Permit (16) Video Tape Copying (17) Certificate of Public Convenience of Necessity, Renewal (18) Temporary Vendor Permit (19) Registrant, Drug or Sex Offender (20) Correction Citation (21) Vehicle Impound Storage, Public and Private (22) Paramedic, Non-resident, Basic and Advanced (23) Fire Clearance Inspection (24) Vacation or Abandonment of Right -of -Way (25) Public Right -of -Way Inspection (26) Job Center Processing Fee Section 15. Publication. This Ordinance shall take effect and be in full force and effect thirty (30) days from and after its passage and, before the expiration of fifteen (15) days after its passage, shall be published once in the NEWPORT BEACH -COSTA MESA PILOT, a newspaper of general circulation printed and published in the City of Costa Mesa, or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15 ) days after adoption, the City 7 shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
