HomeMy WebLinkAbout95-07 Limit Size of InflatablesORDINANCE NO. 95 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING ARTICLE 1 OF CHAPTER VI OF TITLE 5 OF THE COSTA MESA MUNICIPAL CODE TO LIMIT,THE.SIZE AND HEIGHT OF INFLATABLES (ADVERTISING BALLOONS). - THE CITY COUNCIL OF THE'CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. "The City Council of the City of Costa Mesa finds and declares as follows: (a) The City's current -sign ordinance was adopted in 1974, and provides for the use of advertising balloons and other inflatable objects as temporary special event signing;. and (b) Recently, the City has experienced an increase in the use of large balloons and other inflatable objects for advertising purposes; and (c) - It is the desire of the City Council to regulate the size and height of inflatable objects to limit adverse impacts on the visual image of the city and to reduce the potential hazards from unregulated use and display of large inflatable and aerial objects. ACCORDINGLY, the City Council of the.City of Costa Mesa hereby amends the Costa Mesa Municipal Code as follows: Section 2. Paragraph (4) of Subsection,(b) [Prohibited Signs] of Section 5-121 of Article 1, Chapter VI Title 5. is amended to read as follows: (4), Flags, banners, and pennants,- except as authorized in Section 5=121(d); Section 3. Paragraph (6) of Subsection (c) [Exempted Signs] of Section 5-121 of Article 1, Chapter VI, Title 5 is amended to read as follows: (6) Any balloon which does not exceed twenty-four (24) inches in diameter provided that such balloons may not. be fabricated of, metallic materials, must be securely anchored and may not extend beyond any property line or over any public right-of-way regardless of wind conditions and that such balloons are properly disposed of at the end of the display and may not be released into the air. Section 4. Paragraph (1) of Subsection -(d) [Special Event Signing]. of Section 5-121' of Article 1, Chapter VI, Title 5 is amended to read as follows: (1) General. Flags, banners and pennants may be approved for a limited period of time as a means of advertising. Section 5. Paragraph (4) of Subsection (d) [Special Event Signing] of Section 5-121 of Article 1, Chapter VI, Title 5 is amended to read as follows: (4) Reserved. Section 6. Severability. If any provision or clause of this ordinance or the application thereof to any" person or circumstance is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect other provisions or clauses or applications of this ordinance which can be implemented without the invalid provision, clause or application; and to this end, the provisions of this ordinance are declared to be severable. Section 7. Publication. This ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for .and against the same.
