AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ADDING SECTION 5-5 TO
TITLE 5 OF THE COSTA MESA MUNICIPAL CODE
ESTABLISHING A BUILDING STANDARD FOR PUBLIC
ACCESS ALLEYS ON PRIVATE PROPERTY.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. Section 5-5 is hereby added to Chapter 1 of Title 5 of the Costa
Mesa Municipal Code to read as follows:
"Sec. 5-5 Building Standards for Public Access Alleys on Private, Property.
In addition to the regulations adopted in Section 5-1, City Council
finds that the public health, safety and welfare is protected by prescribing
a uniform building standard for the construction and rehabilitation of
alleys located on private property and used for ingress and egress by the
public. All public access alleys on private property constructed or
rehabilitated under a permit issued after the effective date of this section
shall comply with City Standard No. 118, Typical Section for. Alley and
'V' Gutter, established by the Public Services Department and attached
as Exhibit 1 and incorporated herein by this reference. The building
standard provided in this section shall apply to all public access alleys on
private property where the cost of construction or rehabilitation work
exceed fifty percent (50%) of the total replacement cost of the alley
subject to a permit issued under this Title."
Section 2. Publication.
This Ordinance shall take effect and be in full force and effect thirty (30) days
from and after its passage and, before the expiration of fifteen (15) days after its
passage, shall be published once in the NEWPORT BEACH -COSTA MESA PILOT, a
newspaper of general circulation printed and published in the City of Costa Mesa, or,
in the alternative, the City Clerk may cause to be published a summary of this
Ordinance and a certified copy of the text of this Ordinance shall be posted in the
office of the City Clerk five (5) days prior to the date of adoption of this Ordinance,
and within fifteen (15) days after adoption, the City Clerk shall cause to be published
the aforementioned summary and shall post in the office of the City Clerk a certified
copy of this Ordinance together with the names of the members of the City Council
voting for and against the same.
