AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, CHANGING
THE ZONING OF CERTAIN PROPERTIES IN THE
NEWPORT BOULEVARD SPECIFIC PLAN AREA, BY
ADOPTION OF REZONE PETITION R -97-01B.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. The City Council of the City of Costa Mesa finds and declares as
follows:
WHEREAS, the Newport Boulevard Specific Plan was adopted by City Council
Resolution 496-69 in July 1996; and
WHEREAS, included in the specific plan was an implementation program which
recommended rezoning certain commercially -zoned properties to a residential zoning
district; and
WHEREAS, the proposed rezones are consistent with the 1990 General Plan
designation of Commercial -Residential; and
WHEREAS, the mitigated negative declaration prepared for the Newport
Boulevard Specific Plan SP -96-01 and General Plan Amendment GP -96-01B, previously
adopted by the City Council on July 15, 1996, has been determined to be adequate for the
proposed amendments to the City of Costa Mesa Official Zoning Map. The evidence
presented in the record as a whole indicates that the project will not individually or
cumulatively have an adverse effect on wildlife resources or habitat; therefore a
DeMinimus Finding is adopted along with the previous Negative Declaration.
ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends the
City of Costa Mesa Official Zoning Map as follows:

Section 2. There is hereby placed and included in the R2 -MD zoning district
all that real property shown on attached Exhibit A and described in attached Exhibit B,
situated in the City of Costa Mesa, County of Orange, State of California.
Section 3. There is hereby placed and included in the R2 -HD zoning district
all that real property shown on attached Exhibit C and described in attached Exhibit D,
situated in the City of Costa Mesa, County of Orange, State of California.
Section 4. Pursuant to the provisions of Section 13-79 of the Costa Mesa
Municipal Code, District Maps G-3 and G-4 of the City of Costa Mesa are hereby
amended by the change of zone described in Sections 2 through 4 hereof and in the
respective exhibits. Copies of the District Maps are on file in the office of the Planning
Division.
Section 5. Severability
If any provision or clause of this ordinance or the application thereof to any person or
circumstances is held to be unconstitutional or otherwise invalid by any court of
competent jurisdiction, such invalidity shall not affect other provisions or clauses or
applications of this ordinance which can be implemented without the invalid provision,
clause, or application; and to this end, the provisions of this ordinance are declared to be
severable.
Section 6 Publication
This ordinance shall take effect and be in full force thirty (30) days from and after the
passage thereof, and, prior to the expiration of fifteen (15) days from its passage, shall be
published once in the ORANGE COAST DAILY PILOT, a newspaper of general
circulation, printed and published in the City of Costa Mesa or, in the alternative, the City
Clerk may cause to be published a summary of this Ordinance and a certified copy of the
text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to
the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the
City Clerk shall cause to be published the aforementioned summary and shall post.in the

office of the City Clerk a certified copy of this Ordinance together with the names of the
members of the City Council voting for and against the same
