AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, AMENDING
SUBSECTION (a) OF SECTION 2-189 OF THE COSTA
MESA MUNICIPAL CODE PERTAINING TO LIABILITY
CLAIMS.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. The City Council of the City of Costa Mesa, California, does
hereby find and declare as follows:
WHEREAS, the City Council has established an Insurance Committee to
allow, reject, compromise or settle claims against the City of Costa Mesa in an
amount not to exceed twenty-five thousand dollars ($25,000.00); and
WHEREAS, the California Government Code section 935.4 authorizes the
City Council to extend the authority of the Insurance Committee to allow, reject,
compromise or settle claims against the city of Costa Mesa up to an amount not to
exceed fifty thousand dollars ($50,000.00).
Section 2. Subsection (a) of Section 2-189 of the Costa Mesa Municipal
Code is hereby amended to read as follows:
a) The City Council authorizes an Insurance Committee, comprised of
the City Manager, Director of Finance and City Attorney, or designees,
to perform such functions of the City Council as provided in Chapter 5
of Title 1 of the Government code, including the rejection or
negotiation of all claims and settlement of any claim where the
amounts to be paid pursuant to an allowance, compromise or
settlement does not exceed twenty-five thousand dollars
25,000.00). Upon approval of a majority of the Insurance
Committee, the Director of Finance shall cause a warrant to be issued
upon the treasury of the City in the amount for which a claim has been
allowed, compromised or settled."
Section 3. Publication.
This Ordinance shall take effect and be in full force and effect thirty (30)
days from and after its passage and, before the expiration of fifteen (15) days after
its passage, shall be published once in the NEWPORT BEACH -COSTA MESA PILOT,
a newspaper of general circulation printed and published in the City of Costa Mesa,
or, in the alternative, the City Clerk may cause to be published a summary of this
Ordinance and a certified copy of the text of this Ordinance shall be posted in the
office of the City Clerk five (5) days prior to the date of adoption of this Ordinance,
and within fifteen (15) days after adoption, the City Clerk shall cause to be
published the aforementioned summary and shall post in the office of the City Clerk
a certified copy of this Ordinance together with the names of the members of the
City Council voting for and against the same.
