HomeMy WebLinkAbout97-30 Adopting Rezone Petition R-97-06; Newport Blvd and E 19th StORDINANCE 97-30 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING REZONE PETITION R-97-06 CHANGING THE ZONING OF EIGHT ADJOINING PARCELS AT 1884 AND 1898 NEWPORT BOULEVARD AND 145 EAST 19TH STREET, BUILDINGS A -C FROM C1, C2 AND P TO PLANNED DEVELOPMENT COMMERCIAL (PDC) THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1.: There is hereby placed and included in the PDC zone all the real property shown on attached Exhibit "1" and described as 1884 and 1898 Newport Boulevard and 145 East 19"' Street, Buildings A -C, Assessor Parcel Numbers 425-453- 02, 03, 04, 10, 11, 12, 13, 14 situated in the City of Costa Mesa, County of Orange, State of California, to wit: Parcel 1: (Parcels .1, 2 and 3 are portions of 425-453-02) The northwesterly 189 feet of lot 161, Newport Heights, as shown on a map recorded in Book 4, Page 83, Miscellaneous Maps, records of Orange County, California. Excepting therefrom the northeasterly 140 feet and the southwesterly 87 feet of said lot 161. Parcel 2: The northwesterly 48.85 feet of the northeasterly 4.80 feet of the southwesterly 85.67 feet of lot 161, Newport Heights, as shown on a map recorded in Book 4, Page 83, Miscellaneous Maps, records of Orange County, California. Parcel 3: The southwesterly 87.00 feet of the northwesterly 189.00 feet of lot 161, Newport Heights, as shown on a.map recorded in Book 4, Page 83 of Miscellaneous Maps, records of Orange County, California. Excepting therefrom the southwesterly 85.67 feet thereof. Parcel 4: (425-453-11, 12) Lot 13 of Tract No. 3229, as shown on a map recorded in Book 100, Page 12 of Miscellaneous Maps, records of Orange County, California. Excepting therefrom that portion described in that certain deed to the City of Costa Mesa recorded February 25, 1983 as Instrument No. 83-084939 of official records of said Orange County, described as follows: Beginning at the most northerly corner of said lot 13, said corner also being a point on the southwesterly line of 19`h Street; thence south 39° 47'43" west along the northwesterly line of said lot 13 a distance of 40.00 feet; thence south 50° 11' 10" east along a line parallel and 40.00 feet southwesterly of the southwesterly line of 19`h Street a distance of 228.77 feet; thence south 53° 14' 16" east a distance of 112.17 feet to the southeasterly line of said lot 13; thence north 39° 48' 45" east along said southeasterly line a distance of 34.03 feet to the southwesterly line of 19`h Street; thence north 50° 11' 10" west along said southwesterly line of 19`h Street a distance of 340.79 feet to the point of beginning. Parcel 5: (425-453-14) The northeasterly 140.00 feet of the northwesterly 189.00 feet of lot 161 of Newport Heights, as shown on a map recorded in Book 4, Page 83 of miscellaneous Maps, records of Orange County California. Excepting therefrom the northwesterly 139.00 feet thereof. Also excepting therefrom that portion lying within a strip of land 9.00 feet wide, the southwesterly line of said strip being 69.00 feet southwesterly and parallel to the centerline of 19`h Street. Parcel 6: (425-453-03, 04, 13) Lots 1 to 12 inclusive of Tract No. 3229, as shown on a map recorded in Book 100, Page 12 of Miscellaneous Maps, records of Orange County California. Excepting therefrom that portion of said lot 12 described as follows: Beginning at the most northerly corner of said lot 12, said corner also being a point on the southwesterly line of 19`h Street; thence south 39° 48' 45" west along the northwesterly line of said lot 12, a distance of 34.03 feet; thence south 53° 14' 16" east a distance of 41.10 feet to the beginning of tangent curve concave westerly and having a radius 18.00 feet; thence southerly and southwesterly along said curve through a central angle of 93° 03' 01" an arc distance of 29.23 feet to a point on the northwesterly line of Fullerton Avenue as shown on said tract; thence north 39° 48' 45" east along said northwesterly line, a distance of 34.816 feet to the beginning of a tangent curve concave westerly and having a radius of 15.00 feet; thence northerly and northwesterly along said curve through a central angle of 89° 59' 55" an arc distance of 23.56 feet to a point on the southwesterly line of 19"' Street as shown on said tract; thence north 50° 11' 10" west along said southwesterly line, a distance of 45.00 feet to the point of beginning. Parcel 7: (425-453-10) The northwesterly 139 feet of the northeasterly 140 feet of Lot 161 of Newport Heights, in the City of Costa Mesa, County of Orange, State of California, as shown on a map thereof recorded in Book 4, page 83, Miscellaneous Maps, in the office of the County Recorder of said County. SECTION 2.: Pursuant to the provisions of Section 13-79 of the Costa Mesa Municipal Code, District Map G-2 of the City of Costa Mesa is hereby amended by the change of zone described in Section 1 hereof and in the respective Exhibit. Copies of the District Maps are on file in the office of the Planning Division. SECTION 3.: This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names and member of the City Council voting for and against the same.
