AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, AMENDING
SECTION 2-189 OF THE COSTA MESA MUNICIPAL
CODE PERTAINING TO LIABILITY CLAIMS AGAINST
THE CITY OF COSTA MESA.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1.. The City Council of the City of Costa Mesa, California, does hereby find
and declare as follows:
WHEREAS, the City Council has established an Insurance Committee to allow, reject,
compromise, or settle claims against the City of Costa Mesa in an amount not to exceed five
thousand dollars ($5,000.00); and
WHEREAS, California Government Code Section 935.4 authorizes the City Council to
extend the authority of the Insurance Committee to allow, reject, compromise, or settle claims
against the City of Costa Mesa up to an amount not to exceed fifty thousand dollars
($50,000.00).
SECTION 2. Section 2-189 of the Costa Mesa Municipal Code is hereby amended to
read as follows:
"(a) The City Council authorizes an Insurance Committee, comprised of the City
Manager, Director of Finance, and City Attorney, to perform such functions of
the City Council as provided in Chapter 5 of Title 1 of the Government Code,
including the rejection or negotiation of all claims, and settlement of any claims
where the amounts to be paid pursuant to an allowance, compromise, or
settlement does not exceed twenty-five thousand dollars ($25,000.00). Upon
approval of a majority of the Insurance Committee, the Director of Finance shall
cause a warrant to be issued upon the treasury of the City in the amount for
which a claim has been allowed, compromised, or settled.
(b) The Risk Manager is hereby authorized, with the concurrence of the City
Attorney, to allow, reject, compromise, or settle any tort claim for a sum not to
exceed five thousand dollars ($5,000.00)."
SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from
and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage
shall be published once in a newspaper of general circulation, printed and published in the City
of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of
this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of
the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen
(15) days after adoption, the City Clerk shall cause to be published the aforementioned summary
and shall post in the office of the City Clerk a certified copy of this Ordinance together with the
names of the members of the City Council voting for and against the same.
PASSED AND ADOPTED this 15th day of July, 1996.
