AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA AMENDING TABLE 13-69 IN
TITLE 13 OF THE COSTA MESA MUNICIPAL CODE
REGARDING VERY LOW TRAFFIC USES IN THE
COMMERCIAL -RESIDENTIAL LAND USE DESIGNATION.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN
AS FOLLOW:
SECTION 1. The City Council of the City of Costa Mesa finds and declares
as follows:
1. The California Government code Section 65850 enables the City of
Costa Mesa to regulate the use of property within the City; and
2. The development of very low traffic uses with a maximum floor area
ratio of 0.75, such as mini -warehouses, in the Commercial -Residential
land use designation is not consistent with the purpose of the Newport
Boulevard Specific Plan; and
3. The regulations have been reviewed according to the California
Environmental Quality Act (CEQA) and have been found to be exempt
under Section 15061 (b)(3) of the CEQA Guidelines.
ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends
the Costa Mesa Municipal Code as follows:
SECTION 2. The following row of Table 13-69 of the Costa Mesa Municipal
Code is hereby amended to read as follows:

SECTION 3. Severability
If any provision or clause of this ordinance or the application thereof to any
person or circumstances is held to be unconstitutional or otherwise invalid by any
court of competent jurisdiction, such invalidity shall not affect other provisions or
clauses or applications of this ordinance which can be implemented without the
invalid provision, clause, or application; and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 4. Publication
This ordinance shall take affect and be in full force and effect thirty (30) days
from and after its passage and, before the expiration of fifteen (15) days after its
passage, shall be published once in a newspaper of general circulation printed and
published in the City of Costa Mesa. In the alternative, the City Clerk may cause to
be published a summary if this ordinance and, a certified copy of the text of this
ordinance shall be posted in the office of the City Clerk five (5) days prior to the date
of adoption of this ordinance. Within fifteen (15) days after adoption, the City Clerk
shall cause to be published the aforementioned summary and shall post in the office of
