A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, DECLARING THAT THE PORTABLE OFFICE COMPLEX PROJECT
NO. 16-15 CAN BE PERFORMED MORE ECONOMICALLY BY EMPLOYEES OF THE
CITY AND AUTHORIZING THIS PROJECT TO BE DONE BY FORCE ACCOUNT
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, on August 22, 2016, the City received and opened three (3) bids for
Project No. 16-15, the Portable Office Complex and Site Construction project (the
"Project'); and
WHEREAS, the Project includes the delivery, assembly, and lease of a 64ft by 48ft
modular housing trailer; construction of a Fire Engine Shelter, delivery of an 8ft by 20ft
lockable storage container and two 8ft by 40ft lockable storage containers, construction
of a concrete access driveway, installation of utilities, and construction of a privacy/safety
fence along the perimeter of the site; and
WHEREAS, The Project will provide temporary living and working quarters for fire
crews currently staffed at Fire Station No. 1 during the construction phase, which will
permit the Fire Department to maintain an effective presence geographically and provide
general services to the residents of Costa Mesa in an efficient manner; and
WHEREAS, the apparent low bidder timely requested withdrawal from
consideration of its bid due to an error in calculating the bid pursuant to California Public
Contract Code section 5101 et seq; and

WHEREAS, the second lowest bidder, while responsive to the proposal
instructions, submitted a bid in an amount exceeding the Project cost estimate by
approximately 39%; and
WHEREAS, based on the Project cost estimate, staff has determined that the
Project can be performed more economically by the employees of the City by having the
Project done by force account; and
WHEREAS, for the aforementioned reasons, staff recommended and City Council
rejected all bids.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Costa
Mesa, California, hereby declares that Project No. 16-15 can be performed more
economically by the employees of the City by having the Project done by force account
pursuant to Public Contracts Code section 22038, Costa Mesa Municipal Code section 2-
178, and City of Costa Mesa Purchasing Policy section 15-102.
