A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, OPPOSING PROPOSITION 57, THE CALIFORNIA PAROLE FOR NON-
VIOLENT CRIMINALS AND JUVENILE COURT TRIAL REQUIREMENTS INITIATIVE
THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, Proposition 57, known as the California Parole for Non -Violent
Criminals and Juvenile Court Trial Requirements Initiative, is on the November 8, 2016
ballot; and
WHEREAS, Proposition 57 is an initiated constitutional amendment and state
statutory amendment that would make persons convicted of nonviolent felonies eligible
for parole consideration after completing the full term for their primary offenses and would
allow the California Department of Corrections and Rehabilitation (CDCR) to award
sentence credits for good behavior and approved rehabilitative or educational
achievements; and
WHEREAS, Proposition 57 would require juvenile court judges, rather than
prosecutors, to determine whether juveniles 14 years of age or older should be
prosecuted and sentenced as adults for specified offenses; and
WHEREAS, Proposition 57 is intended to reduce overcrowding in state prisons
while rehabilitating juvenile and adult offenders; and
WHEREAS, at the beginning of 2016, it was estimated that Proposition 57 would
give the approximately 25,000 nonviolent state prisoners an opportunity for early release,
by allowing the parole board to consider them for parole after they serve the full term for

their primary offense, but before they serve the time added by sentencing enhancements;
and
WHEREAS, since the 2014 passage of Proposition 47, which re -categorized
certain nonviolent and non -serious offenses as misdemeanors and was intended to
reduce overcrowding in state prisons, cities throughout the state have experienced an
increase in property crimes. The City Council is concerned that Proposition 57 will have
a similar negative impact on crime in the Costa Mesa community.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF COSTA MESA that, due to the potential negative impacts that Proposition 57 may
have on crime in the Costa Mesa community, the City of Costa Mesa hereby opposes
Proposition 57.
