AN ORDINANCE OF THE CITY OF COSTA MESA,
CALIFORNIA, AMENDING TITLE S OF THE COSTA
MESA MUNICPAL CODE TO ESTABLISH MINIMUM
SERVICE REQUIREMENTS FOR WASTE HAULING
SERVICE FOR MULTI -FAMILY RESIDENTIAL
HOUSING.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. The City Council of the City of Costa Mesa does hereby find and declare
as follows:
A. WHEREAS, there is an increasing problem of overflowing trash bins and
containers and an unsightly number of trash bins and containers from multi -family residential
housing; and
B. WHEREAS, waste hauling industry standards have established that a single
dwelling unit produces an average of/z cubic yard of refuse per dwelling unit per week.
C. WHEREAS, the overflow and excess number of trash bins leads to extensive litter
problems, visual blight- and potential health hazards, and
D. WHEREAS, the current municipal code does not establish appropriate minimum
service requirements for multi -family residential housing; and
E. WHEREAS, establishing minimum service and capacity requirements for waste
hauling for multi -family residential housing will substantially resolve the problem of
overflowing and excess number of trash bins, litter and visual blight caused by such overflowing
and excess number of trash bins and will serve to protect the public's health, safety and welfare.
Section 1. Section 8-81 (b) of Title 8, Chapter IV of the Costa Mesa Municipal Code
is hereby amended to read as follows:
"8.81 (b) The schedule for collection from commercial and industrial units shall be
determined by the permittee and occupants of such units and subject to review by the director of
public services."
Section 2. . New Section 8-81 (c) of Title 8, Chapter IV of the Costa Mesa Municipal
Code is hereby added. The new section 8-81 (c) shall read as follows:
"8-81 (c) . The permittee shall provide all multi -family residential units a container or
containers that have a minimum storage capacity of/2 cubic yard of refuse per dwelling unit per
week. The minimum service standards are subject to review by the director of public services."
Section 3. New Section 8-81 (d) of Title 8, Chapter IV of the Costa Mesa Municipal
Code is hereby added and the subsequent paragraphs renumbered. The new section 8-81 (d)
shall read as follows:
"8-81 (d) All collections of refuse frorn multi -family residential units of five or more
dwelling units shall be made from private property except where the director of public services
has made a written determination that there is a physical limitation or documented safety issue(s)
that prevents collection service from private property.
Section 4. Severability. If any section, subsection,, sentence, clause, phrase, or portion of
this Ordinance is for any reason held to be invalid or unenforceable by a court of competent
jurisdiction, the remaining sections, subsections, sentences, clauses, phrases, or portions of this
Ordinance shall nonetheless remain in frill force and effect. The people of the City of Costa
Mesa hereby declare that they would have adopted each section, subsection, sentence, clause,
phrase, or portion of this Ordinance, irrespective of the fact that any one or more sections,
subsections, sentences, clauses, phrases, or portions of this Ordinance be declared invalid or
unenforceable.
ection 5. Publicatio
This Ordinance shall take effect and be in frill force and effect thirty (30) days from and
after its passage and, before the expiration of fifteen (15) days after its passage, shall be
published once in the NEWPORT BEACH -COSTA MESA PILOT, a newspaper of general

circulation printed and published in the City of Costa Mesa, or, in the alternative, the City Clerk
may cause to be published a summary of this Ordinance and a certified copy of the text of this
Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of
adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause
to be published the aforementioned summary and shall post in the office of the City Clerk a
certified copy of this Ordinance together with the names of the members of the City Council
voting for and against the same.
