Section 1. Findings.
The City Council of the City of Costa Mesa finds and declares that Ordinance
No. 01-2 was adopted on January 15, 2001, as an urgency interim ordinance to
allow sufficient time for the City to complete a review of existing residential
development standards and parking regulations and to take any necessary steps to
implement the recommendations resulting from the study; that the interim
ordinance forbade the issuance of any building permits for the construction of any
new, or the remodel of any existing, single-family residences located on R-1 zoned
property when the completed structure would have a floor area ratio (F.A.R.) of
greater than 0.5; that since the adoption of the interim ordinance the City staff has
worked diligently to complete the study and new proposed standards are being
processed for adoption, but that additional time is still needed for this purpose; that
at least 10 days before the interim ordinance expires a written report pursuant to
Government Code section 65858(d) was issued describing the measures taken to
alleviate conditions leading to the adoption of the interim ordinance; and that there
continues to be a current and immediate threat to the public health, safety, or
welfare and that approval of any of the prohibited uses would result in that threat
to the public health, safety, and welfare.
