AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, AMENDING
ORDINANCE NO. 95-9 TO CHANGE THE NAME OF THE
BUSINESS IMPROVEMENT AREA COVERING CERTAIN
COSTA MESA HOTELS AND MOTELS.
THE CITY COUNCIL OF THE CITY OF COSTA.MESA DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. The City Council of the City of Costa Mesa hereby finds and
declares as follows:
WHEREAS, the California :.Legislature, in adopting the Parking and .Business
Improvement Area Law of 1989 (Streets & Highways Code § 36500 et. seq.)
authorized cities to levy assessments on businesses in order to promote economic
revitalization and tourism, to create jobs, attract new businesses and prevent
erosion of business; districts; and
WHEREAS, on- July 5, 1995, by Ordinance No. 95-9, the City Council
adopted a business improvement area, originally known as the Costa Mesa
Tourism & Promotion Council, the purpose of which is to promote tourism to the
City and to fund programs that benefit the hotel and motel businesses within the
City of Costa Mesa; and
WHEREAS, the City Council desires to change the name of the "Costa Mesa
Tourism & Promotion Council" to the "Costa Mesa Tourism & Promotion Business
Improvement. Area" (the "BIA") as this is the name that the district is more
commonly known.
Section 2. The City Council, by this ordinance, does hereby rename the
Costa Mesa Tourism & Promotion Council to the "Costa Mesa Tourism &
Promotion Business Improvement Area"
Section 3. This ordinance is intended to amend Ordinance No. 95-9 and
any successor or supplemental ordinances and/or resolutions with regard to the
official name of said assessment district. Any ordinance or resolution inconsistent
with this Ordinance or that uses the name Costa Mesa Tourism & Promotion
Council is hereby. amended by replacing the name Costa Mesa Tourism &
Promotion Council with the name Costa Mesa Tourism and Promotion Business
Improvement Area. All ordinances and resolutions are hereby amended to the
extent of such inconsistencies and no further, and are hereby repealed or modified
to that extent necessary to affect the provisions of this Ordinance. All remaining
provisions of any affected ordinance or resolution are to remain in full force and
effect.
Section 4. If any section, subsection, sentence, clause, phrase, or portion
of this ordinance is for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this Ordinance. The City Council of the City
of Costa Mesa hereby declares that it would have adopted this Ordinance and
each section, subsection, sentence, clause, phrase, or portion thereof, irrespective
of the fact that any one or more sections, subsections, sentences, clauses,
phrases, or portions be declared invalid or unconstitutional.
Section 5. The Mayor shall sign and the City Clerk shall certify to the
passage and adoption of this Ordinance and shall cause the same to be published
and posted pursuant to the provisions of law in that regard and this Ordinance
shall take effect thirty (30) days after its final passage.
