AN URGENCY ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA EXTENDING INTERIM ORDINANCE
NOS. 01-2 AND 01-9 IMPOSING A MORATORIUM
ON CONSTRUCTION OF CERTAIN NEW
RESIDENCES AND REMODELS ON R-1 LOTS
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. Findings.
The City Council of the City of Costa 'Mesa -finds and declares that
Ordinance No. 01-2 was adopted on January 15, 2001, as an urgency interim
ordinance to allow sufficient .time for the City, to complete a review of existing
residential development standards and parking regulations and to take any
necessary steps to implement the recommendations resulting from the study; that
the interim ordinance forbade the issuance of any building permits for the
construction of any new, or the remodel of any existing, single-family residences
located on R-1 zoned property when the completed structure would have a floor
area ratio (F.A.R.) of greater than 0.5; that since the adoption of the interim
ordinance the. City staff has worked diligently to complete the study and new
proposed standards are being processed for adoption, but that additional time is
still needed for this purpose; that at least 10 days before the interim ordinance
expires a written report pursuant to Government Code section 65858(d) was
issued describing the measures taken to alleviate conditions leading to the
adoption of the interim ordinance; and that there continues to be a current and
immediate threat to the public health, safety, or welfare and that approval of any
of the prohibited uses would result in that threat to the public health, safety, and
welfare. Ordinance 01-9 was adopted on February 20, 2001, to extend the effect
of the moratorium until July 15, 2001.
Section 2. Extension.
Interim Ordinances No. 01-2 and 01-9 are hereby extended for an additional
3 days from July 15, 2001, to and including July 18, 2001, pursuant to
Government Code section 65858(a).
Section 3. Effective Date and Publication.
This Ordinance shall take effect and be in full force and effect immediately
from and after its passage and, before the expiration of fifteen (15) days after its
passage, shall be published once in the NEWPORT BEACH -COSTA MESA PILOT, a
newspaper of general circulation, printed and published in the City of Costa Mesa,
or, in the alternative, the City Clerk may cause to be published a summary of this
Ordinance and a certified copy of the text of this Ordinance shall be posted in the
office of the City Clerk five (5) days prior to the date of adoption of this
Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause
to be published the aforementioned summary and shall post in the office of the
City Clerk a certified copy of this Ordinance together with the names of the
members of the City Council voting for and against the same.
