HomeMy WebLinkAbout01-24 Approval of Rezone Petition R-01-02; Prezoning Unincorporated Territory North of Mesa DriveORDINANCE NO. 01-24 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, PREZONING UNINCORPORATED TERRITORY ALONG THE EASTERN 'BOUNDARY OF THE CITY; NORTH OF MESA DRIVE, BY APPROVAL OF REZONE PETITION R-01-02. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS. FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa finds and declares as follows: WHEREAS, the City Council has adopted a resolution of intent to annex unincorporated territory along the eastern boundary of the City north of Mesa Drive; and WHEREAS, as part of the annexation process, the Local Agency Formation Commission (LAFCO) of Orange County may require the prezoning of property prior to approving an annexation request; and WHEREAS, in anticipation of annexation approval, and in an effort to expedite the process, the City Council desires to "prezone" the area in a manner consistent with state statutes on annexation procedures; and WHEREAS, the proposed prezone as specified in rezone petition R-01-02, including any modification by the City Council, is consistent with the Costa Mesa General Plan land use designations for unincorporated property located within the City's Sphere of Influence determined by LAFCO; and WHEREAS, when the annexation is approved, the proposed amendments to the City of Costa Mesa Zoning Map shall take effect; and WHEREAS, it has been determined that the proposed amendments to the City of Costa Mesa Zoning Map will not have any significant adverse effect on the environment when they take effect, and a Negative Declaration has been adopted pursuant to the requirements of the California Environmental Quality Act; and ACCORDINGLY, the City Council of the City of Costa Mesa hereby approves to amend the City of Costa Mesa Official Zoning Map as follows: SECTION 2. Add the I & R, Institutional and Recreational District; the R2 - MD, Multiple -Family Residential District, Medium Density; and the land use district designations of the Santa Ana Heights Specific Plan as enacted per Resolution No. 01- —and situated in the City of Costa Mesa, County of Orange, State of California, as shown on the map attached as Exhibit A and the table attached as Exhibit B. SECTION 3. Pursuant to the provisions of Section 13-79 of the Costa Mesa Municipal Code, District Map G/7 of the'City of Costa Mesa is hereby amended by the change of zone described in Section 2 and in the respective exhibits. Copies of the District Map are on file in the office of the Planning Division. SECTION 4. Severability If any provision or clause of this ordinance or the application thereof to any person or circumstances is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect other provisions or clauses or applications of this ordinance which can be implemented without the invalid provision, clause or application; and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. Publication This ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and, prior to the expiration of fifteen (15) days from its passage, shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of the Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of the Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
