HomeMy WebLinkAbout00-04 Development Standards for Establishments Where Food and Beverages are ServedORDINANCE NO., 00-4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING CHAPTER V, ARTICLE 4, OF TITLE. 13 OF THE COSTA MESA MUNICIPAL CODE, TO CORRECT AN OMISSION IN THE DEVELOPMENT STANDARDS FOR ESTABLISHMENTS WHERE FOOD AND BEVERAGES ARE SERVED. THE CITY COUNCIL OF THE CITY OF COSTA MESA FINDS AND DECLARES AS FOLLOWS: (1) The City of Costa Mesa comprehensively revised its zoning provisions contained in Title 13 of the City of Costa Mesa Municipal Code by adoption of Ordinance No. 97-11; (2) Alcoholic Beverage Control License No. 48 was inadvertently omitted from the list of licenses contained in Section 13-51(b)(1)(f), and therefore, this section needs to be appropriately corrected; and (3) .The correction has been reviewed according to CEQA (California Environmental Quality Act) and has been found to be exempt under Section 15061(b)(3) of the CEQA Guidelines. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 13-51(b)(1)(f) of Title 13 of the Costa Mesa Municipal Code is hereby amended to read as follows: "f. A change from any type of Alcoholic Beverage Control license to any of the following Alcoholic Beverage Control license types: 40 (on -sale beer); 9 42 (on -sale beer and wine for public premises); 48 (on -sale general for public premises); or 61 (on -sale beer for public premises), provided that the establishment is open for customer service any time between the hours of 11 p.m. and 2 a.m." SECTION 2. Publication This Ordinance shall take affect and be in full force and effect thirty (30) days from and after its passage and, before the expiration of fifteen (15) days after its passage, shall be published once in a newspaper of general circulation printed and published in the City of Costa Mesa. In the alternative, the City Clerk may cause to be published a summary if this ordinance and, a certified copy of the text of this ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this ordinance. Within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk, a certified copy of this ordinance together with the names of the members of the City Council voting for and against the same.
